Show oo TliPEN AND OTHERS HAVE BEEN RELEASED Chicago, April 2S. Judge Petit, in the circuit court today, granted a writ of habeas corpus for" Edward Tllden, Geo. M. Benedict and W. C. Cum-mings Cum-mings within a half hour after they had been arrested by E. H.r Hatfield, assistant sergeant-at-arms, of the Illinois Illi-nois state senate. Hatfield bore warrants charging contempt con-tempt of the Illinois senate, refusal of tho three to obey suhpoenns duces tecum cnlling for their appearance with those books and accounts of the Drovers Deposit National bank and the Drovors Trust and Savings bank relating to the accounts of Edward Tllden. Mr. Tllden was montloned In the testimony of Clarence Funk of the International In-ternational Harvester company as tho man to whom he was instructed to send a subscription for tho alleged purpose of aiding In the election of United States Senator William Lorl-mer Lorl-mer Hatfield made no attempt to arrest the three last night upon his arrival hero and they surrendered themselves early today, accompanied by their counsel, Nathanlol C Sears They went at once to the court room where tho writ was issued, returnable forthwith. Among other things, the subpoenas were attached on the g.-ound that they were not supported by an oath or affirmation; af-firmation; that thev did not describe particularly the books showing the receipts re-ceipts and disbursements of money during May, June, July. Ausust and September; that the Helm committee had no power to investigate the con duct of members of tho present as sembly and that the subpoenas were not signed by the president of the senate. |
