Show M'CARTY MAY PROVE HIS INNOCENCE F. V. McCarU, changed with pe,tit larceny in the carrying off of a shotgun shot-gun from a sheep camp east of the city, was given a trial In police court this morning, and partly succeeded In proving his innocence. The court, however, was not quite satisfied and withheld decision until certain points of the man's story can be Investigated When first arraigned a few days ago, McCartv stated that he was willing to i plead guilty to the charge if the court I desired such a plea, hut that he had not really stolen tho gun. He was told by the court that he should not plead gullu unices he was rullty and I a plea of not gulllv was entered for him ' ' He told a story of having never been east of the city, but of meeting a man In the down-town district of the city who had a shotgun which he wanted to sell Ho was asked to take the pin to a second-hand Qtore and soil It, the supposed owner of the gun accompanying accom-panying him to a point near the store The second-band denier gave him a check for $5 for the gun and when he came out of the store ho turned this over to the supposed owner of the gun. This man gave him nothing for his pervices. Willie this stor Is a common one to be told by thieves after their, arrest, there was other evidence brought out to substantiate McCartv's statement The point to be investigated now Is the check which tho prisoner state0, ho did not indorse or cash, but turned over to the man In waiting, If It Is found that this pnper was not Indorsed In tJbo handwriting of McCarty, he no doubt will be liberated by the courL McCarty admitted that he is addicted addict-ed to drugs, but Insisted that h would work whenever he could find work to do. |
