Show ORDINANCE NO. 46 . AN "ORDINANCE CALLING FOR A SPECIAL ELECTION AND' SUBMITTING SUB-MITTING TO THE QUALIFIED TAX PAYING ' ELECTORS , - OF . THE TOWN AT SUCH SPECIAL ELECTION ELEC-TION THE QUESTION OF INCURRING INCUR-RING A BONDED INDEBTEDNESS IN THE AGGREGATE AMOUNT OF SIXTY THOUSAND DOLLARS ($60, 000 ), FOR THE PURPOSE OF SUPPLYING SUP-PLYING THE TOWN WITH WATER WAT-ER BY THE CONSTRUCTION ' OF A SYSTEM OF WATERWORKS. TO BE OWNED AND CONTROLLED BY THE. MUNICIPALITY. AND PEALING ALL ORDINANCES IN CONFLICT HEREWITH. HE IT ORDAINED BY THE PRES 1 DENT AND BOARD OF TRUSTED OF MILFORD. UTAH: Section 1. That a. special election of' such qualified electors of the town of Milford as, shall have paid property prop-erty tax in the year proceeding such election, be called and said election is hereby called for . Thursday, the 24th day of February, A. D. 1921. Section 2. That at said election the following question shall be, a-is a-is hereby, submitted to such qualified quali-fied electors of the town as shall have paid property" tax in the year preceding said' election, towit: "Shall the town of Milford create an indebtedness by issuing Its negotiable nego-tiable coupon bonds in the aggregate aggre-gate amount of Sixty Thousand Dol-Isrs Dol-Isrs ($IO,()BO), due and' payable within twenty years from their dat and bearing interest at the rate of six (fi) ror centum per annum, payable pay-able semi-annually, for the purpose of supplying the town with water, by .the -construction of a system of waterworks, to be owned and controlled control-led by the municipality?" r Section ?,. That the question so sub mitted' shall be voted on at said election el-ection by the voters qualified as -fe-snid. at the Milford onera house, in the town of Milford. The vote shall be by ballot, of the form hereinafter provided, and said election shall ' held and conducted in all respects as nearly as possible in conformity with the ppneral rleetinn laws of the state. Section 4. The ballot to b used in voting upou th quioo alov submitted shall be prepared and furnished fur-nished by the town clerk to the judges judg-es of the election, to be by them furnished fur-nished to the voters, and shall be in substantially the following printed ' form: M1IFORI). UTAH SHcial Water Bond Khvtion OFFICIAL U.ALLOT Question Submitted: "Shall the town of Milford create ::n indebtedness by issuing its negotiable nego-tiable coupon bonds in the aggregate amount of Sixty Thousand Dollars (Oi, OOO), due and payable within twenty yoars from their date, and bearing interest at the rate of six (l) per centum iht annum, payable semi-annually, for the purpose- of supplying the town witli water, by the constinction of a system of wat-i'rworks, wat-i'rworks, to be owned and controlled control-led by the municipality?" For the issue of Bonds. Yes. No. (Each voter shall prepare his ballot bal-lot by crossing out the words "Yes'1 or vNo" so that the word remaining will express his answer to the question ques-tion submitted and shall then deposit de-posit his ballot in the ballot-box provided pro-vided for such purpose.) ' Section 5. No ballot answering said question "Yes" or "No", as the case mav be, shall be received by the judges of r lection, unless the person per-son offering the same shall be a qualified elector n the town of Milford, Mil-ford, and shall have paid a property tax in the year preceding said election elec-tion : Section 6. The following named persons are hereby appointed as judges jud-ges and clerks of said election: Judges i H. H. Pitch forth f s- Herbert Nichols i r. H. Bracifield Section 7. The vote cast at said election on the question submitted shall be canvassed and returned and the return made and the results declared de-clared in the same manner, as nearly as possible, as is provided by law for the canvass, return and declaring declar-ing the results of votes cast at an election for municipal officers. Section 8. A notice of the time and place of said election shall be given by publishing for a period, of not less than four weeks before the date of the election in "The Beaver County News" a newspaper published publish-ed and of general circulation in said town, a notice substantially as follows: fol-lows: MILFORD, UTAH Special Wafer 'Bond Election -PUBLIC NOTICE Pursuant to Ordinance No. 46 of the town of Milford Utah, adopted "and approved the 6thlay of January A. D. 1921, public notice is hereby given that -a special election will be held in said town on Thursday, the 24t'j day of February, A. D. 1921, at the Milford opera house, in said Milford. Mil-ford. - ' At said election there Vill be submitted sub-mitted to a .vote of., such qualiP-electors qualiP-electors of the town as shall have paid a property: "tax therein in the' year preceding such election, the following fol-lowing question: "Shall the town of Milford, create cre-ate an indebtedness by issuing itb negotiable coupon bonds in the aggregate ag-gregate amount of Sixty Thousand Dollars ($60,000), due and payable within twenty years from their date, and bearing interest at the rate of six (6) per centum per annum, pay-'able pay-'able semi-annually, for the purpose of supplying the town with water, by 4he construction of a system oi waterworks, to be owned and controlled con-trolled by the municipality?" The question so submitted wll be voted on at said election by the. voters vot-ers qualified as aforesaid, at the Milford Mil-ford opera house, in the town of Milford, Mil-ford, Utah. The polls will be opened open-ed at seven o'clock a. m. and continue contin-ue open until seven o'clock p, m. the same day, , and will be closed at that hour. . Registration for said election will take place in the manner provided by law. ' .. The ballot to be used in voting on this question submitted will be prepared pre-pared and furnished by the town cleric to the judges of election, to be by them furnished to the voters. . The election will be held and conducted in all respects, as nearly as possible, in comformity with the general election elec-tion laws of the state.' . In Witness Whereof; the board of trustees of the town of Milford, in the state of Utah, have caused this notice to be published as requirea by law, this 6tli day of January, A.. D. 1921. ' .... i E. All ordinances and parts of ordinances, and any section in any ordinance in conflict with any part or portion or in ' conflict with the .whole of .this; ordinance is hereby here-by expressly repealed. Section 10! This ordinance,' immediately imme-diately upon its passage, shall be recorded re-corded in the book of ordinances oi said town kept for that purpose, authenticated au-thenticated and approved by the president of the board of trustees, attested by the town clerk, and shah be published in one issue of the Bea-. ver County News. .... . Section 11. That inasmuch as it is necessary tor the immediate preservation pre-servation of the public peace, health and safety that the town have an adequate ad-equate water supply, an emergency is hereby declared to exist and this order shall take effect immediately after its passage and publication.
