Show ANTI-CIGARETTE BILL ASFRAMED For the benefit of those who are not familiar with the provisions of Senator Southwick's bill, which seems to have created more interest inter-est than any other measure thus far introduced into the legislature, we are publishing it herewith in full. S. B. No. 12 By Mr Southwlck An Act Making it Unlawful to Sell Cigarettes and Cigarette Paper?; tp Advertise Cigarettes ruid Cigarette Ci-garette Peper: to Permit Minors to Smoke in Certain Places of i busine s; For any person to Smoke in Certain Enclosed Public , Places. , Be it enacted by the Legislature of the State of Utah: Section 1. It shall be a misdemeanor misde-meanor for any person, company or corporation to barter, sell, keep for sale, furnish or give away any cigarettes ci-garettes or cigarette papers, or any disguise or subterfuge of either of these, or to have any cigaretteB or cigarette papers in or about any store or other place for barter, sale or free distribution. If, upon what seems to be reasonable evidence, any person, company or corporation Is suspected of having in his or its possession pos-session any cigarettes or cigarette papers intended to be offered for barter, sale or free distribution; then upon the sworn complaint of any citizen of the state of Utah, specifying specify-ing fully as to the alleged facts of the case, any officer authorized to make arrests may, upon the issuance issuan-ce of a search warrant or search war-. war-. rants in the manner and form prescribed pre-scribed in Chapter 56, Title 120, of the code of cririral procedure (Sees 93B7-9380 ), search the premises of such person company or corporation and may seize my cigarettes or cigarette ci-garette papers so found. All such cigarettes or cigarette papers seized under the provisions of this act shall be ordered destroyed by the judge of the court in which final conviction was had. The possession of such cigarette material shall be considered prima facie evidence of a direct violation of this act. Sec. 2. It shall be a misdemeanor for any person, company or corporation corpor-ation within the state of Utah, to print in any circular, newspaper or other-periodical for sale or free distribution dis-tribution within the state of Utah, any advertisement of cigarettes or . cigarette papers, or any disguise or subterfuge of either of these. It shall also be unlawful for any person, per-son, company or, corporation to post exhibit or publish on any street sign, placard, or bill board; or in any package of merchandise, store window, win-dow, showcase, or any other place within the state of Utah, any advertisement adver-tisement for cigarettes or cigarette papers, or any disguise or subterfuge subter-fuge of either of these. See. 3. It fhall be a misdemeanor for the proprietor of any place of . business to knowingly permit min- ors under twenty-one years of age to frequent such place of business while in the act of using tobacco In any form. T' - ipmi "place of business' busi-ness' as here m v! shall apply to any and all such places as shops, stores, factories, public gauges, offices, thoa res, recrator rrc dance balls, pool rooms, cafes, Cafeterias, cabarets, cabar-ets, restaurants. hotels, lodging houses, street cars, interurban and railway passenger coaches and waiting wait-ing rooms. Sec. 4. It shall be a misdemeanor for any perso? to smoke cigarettes or tobacco in any enclosed public place within the state of Utah, except, ex-cept, in extra rooms specially provided provid-ed for smoking purposes. The term "enclosed public place" as here used shall be construed to mean the dining din-ing rooms in hotels, restaurants, cafes and cafeterias; theatres, passenger pas-senger elevators, street cars, interurban inter-urban and railway passenger coaches, coach-es, railway station, waiting rooms, barber shops, state county and city buildings. Sec. 5. If any section, subsection, clause, phrase or word of this act is .for any reason 'held to be unconstitutional, unconsti-tutional, such decision shall not effect ef-fect the validity of the remaining por 1 ions of this act. Sec. G. This act shall take affect and lie in force ninety days from the date of passage. |
