Show CONSTITUTIONAL AMENDMENT NO. 2 . Proposing to Amend 8eotlons 2 and 3, Artlole XIII, of the Constitution Constitu-tion of Utah Relating to Property 8ubect to Taxation and Ratea i of Tax A resolution proposing amendment to Sections 2 and 3, Article 18, of the Constitution of the State of Utah relating" re-lating" to property subject to taxation and rates of tax. Be it resolved by the Legislature of the State of Utah, two-thirds of all the members elected to each house concurring therein : . Section 1. That it is proposed to amend Sections 2 and 8, of Article 13 of the Constitution of the State of Utah, so that such sections will read as follows : Sec. 2. To the end that the burden of taxation may be equitable upon all property, the legislature is empowered to divide all property including moneys mon-eys and credits as well as physical property, into classes and to determine deter-mine what class or classes of property proper-ty shall be subject to taxation and what property, if any, shall not be subject to taxation. Taxes shall be uniform upon all property of the same class and shall be levied and collected collect-ed for public purposes only. Taxes may be imposed upon any and all property, including privileges, fran-ebisee fran-ebisee and licenses .to do business in the state, but this shall not be so construed con-strued as to authorize the taxation of the stocks of any company or corporation corpora-tion when the property of such company com-pany or corporation represented by such stocks has been taxed. Sec. 8. The property of the Unit, ed States, of the state, counties, cities, towns, school districts, municipal corporations cor-porations and psblic libraries, lata with the buildings thereon used -clusively for higher religious worship or charitable purposes and places sf burial not held or used for private r j corporate benefit, and mortgages upon both real and personal property shall he exempt from taxation. Ditches, canals, reservoirs, pipes, and flumes owned and used by individuals or corporations cor-porations for irrigating lands owned by such individuals or corporations, or the Individual members thereof, shall not be separately taxed so long as they shall be owned and used -clusively for such purpose ; a deduc ' tion of debits from credits may be authorized and taxes of the lndlgsn t poor may be remitted or bated at such time and la such manner as may be provided by law. Sec. 2. The secretary of stats ia, directed to cause this proposed nr - ment to be published as require- hy t the constitution and to be submitted to the electors of the state at the next general election la the manner provided pro-vided by law. Sec. 3. If approved by the electors of the state this proposed amendment shall take effect on the first say of January, 1923. Approved March 17. 1921. |
