Show COURT UPHOLDS LODE LOCATIONS The United States Circuit Court of Appeals for the Ninth Circuit, sitting sit-ting at San Francisco, handed down a decision on the 8th of April which will probably become a landmark of property in mining cases between .. aflicting claimants of the same ground, where the earlier claimant holds for the required time - before the conflict occurs. The decision defines de-fines and upholds rights acquired by possession and working of mining claims under the United States Rev. Stat. Sec. 2332 and related sections of the Nevada state statutes. Sec. 2332 provides that where parties have held and worked their claims for the period of time prescribed by the statute of the state or territory where the claims are situated, evidence evi-dence of such possession and working work-ing shall be sufficient to establish right to a patent. |
