Show LETTEROFPROTEST GIVEN TO RAILROAD BY MAYOR HUBBELL Senator 'George Jefferson's letter of protest to the town board demanding adequate protection of the town against the flood menace is now in the hands of the officials of the Union Pacific Railroad, Mayor Hubbell reported re-ported last Thursday at the regular meeting of the town trustees. At the preceeding meeting of the board, Senator Jefferson offered a verbal ver-bal protest against the lack of drainage drain-age to protect the town from flood antl he was requested by Mayor Hubbell to present his objections in writing. Last week the senator presented his letter to the Mayor who turned it over to the Union Pacific Railroad. The contents of the letter are as follows: June 26, 1931 To the Members of the Board, Town of Milford, Beaver County, Utah. Gentlemen : This letter is confirmation of verbal ver-bal protests that have been -repeatedly made in the past by our company, regarding the control of flood waters A. caused by cloud bursts west of Mil- ford: - The bridge on the Frisco branch and the ibridge south of the roundhouse, being inadequate to carry off the flood waters, have in the past allowed a portion of the flood waters to enter the southern part of our town. These floo'd waters have been carried in a northerly direction over the Los An-' An-' geles and Salt Lake Railroad Company's Com-pany's property, just east of Main Street, to a point east of the railroad right-of-way, so that there very little damage done to private property. During the past fifteen years the railroad company has been filling up the natural channels which drained the flood waters in this area, and have been so doing without making adequate ade-quate provision for future drainage. This drainage was further hampered hamper-ed by the pavement constructed from Main Street to the railroad tracks on the county road. At the time this pavement was being constructed we made verbal protest about adequate drainage not being provided. Because of these natural channels being closed, during the last flood the waters came down Main Street, flooded flood-ed our company's premises, and caused caus-ed us actual damage exceeding $600.00. It is our contention that all these damages resulted from the natural channels being filled in during the past fifteen years without adequate provision being made for flood water A. diversion. Subsequent to the last flood the rail-, rail-, road company had their engineers in vestigate this matter. As a result thereof, they acquired a right-of-way for a flood canal, and at the same time informed the townspeople and the town that such canal would be built at oiict. Now, after the lapse of almost al-most two years, we see no progress being made in the completion of this work. It is our belief that the roalroad company does not wish their own property pro-perty menaced by floods. Somehow this matter has been forgotten or laid aside, and under these circumstances it is the duty of the Town of Milford to call it to their attention. When this is once done, there is little question ques-tion that they will take immediate steps towards remedying this situation. situa-tion. We are hereby serving notice on the Town of Milford, and the Los Angeles An-geles and Salt Lake Railroad Company, Com-pany, that we shall hold both, or either, eith-er, liable for all damages to our property pro-perty resulting from future floods, whether the same is caused from negligence neg-ligence in diverting the flood waters from their natural channels, or negligence negli-gence in any other manner.
