Show AN ORDINANCE An ordinance relating to the manufacture, man-ufacture, sale, giving away, or otherwise other-wise disposing of Intoxicating liquors within the corporate limit of Logan City, nod providing y penalty there-' for, and re-enacting sections 429 480 4SL4'4tS 484 415 48$ 487 488 '44 and 44X and amending' sections 489 nnd 442 of the revised ordinances of Logan City, 1918. Be It ordained by the board of city' commissioners of Logan city, Utah, as. follows: 429. Sale of' prohibited. That no one within tho lbnlta of Logan City, by himself, his clerk, servant, employee, em-ployee, or agent,, shall for himself. or any person elso directly or Indirectly Indi-rectly or upon any pretelnso or any device, except as provided in this or-dlnanco or-dlnanco manufacture, sell, exhango, barter, dispense, serve, give In con? stdcr&tlon of tho purchase of any property or of any services, or In evasion of this ordlnanco, or keep for sale, any intoxicating liquor, or solicit, so-licit, tako or accept nn order for tho purchase, salo, shipment sorvleo or do-of do-of any such liquor, or aid In tho do-livery- and distribution of any Intoxicating Intox-icating liquor so ordered or shipped or owjn, keop, or bo in any way con-corned, con-corned, engaged or employed in owning, own-ing, or keeping for salo any Intoxl-eating Intoxl-eating liquor with intent to vlolato &.iy provision of this ordlnanco or authorlzo or permit tho samo to bo dono. 430. Soliciting solo prohibited. It shall, bo Unlawful for any person to solicit within tho corporate limits of Logan City, the sale of any Intoxicating Intoxicat-ing liquors, either In person or by sign, circular, letter, card, price list, advertisement, or otherwise The provisions of this section shall not apply to a person soliciting orders from a licensed druggist. 431. Permit to sell on premises. It shall be unlawful for any owner, les-, sor, lessee or personam possession of any,bulldlng, room, booth, enclosure or other' place within Logan City to permit any person to Bell, keep for sale, give away or otherwise dliposa of any intoxicating liquors In or on such promises, except as provided in this ordinance. 432. Salo upon prescription. Any registered pharmacist may sell and furnish intoxicating liquors for medical med-ical purposes only, upon the written prescription of a regularly practicing practic-ing physician of the state of Utah, in the mannor herein provided. The prescription shall contain tho nnmo of the person prescribed for, tho quantity and kind of liquor prescribed and shall bo signed by tho prescribing prescrib-ing physlclnjn. No prescription shall bo filled hereunder except upon tho day upon which It Is dated and Issued, Is-sued, or upon the following day. On, tho first day of June and January of each year the registered pharmacist shall Mo all such proscriptions filled within tho preceding six months, with tho city recorder of Logan City. Such prescriptions shall, at aiiy time after having been filled, be open to public pub-lic Inspection. A feo of $1.00 for each lot of prescriptions so filled shall bo paid by the said druggist to tho city recorder. Provided, however that, If Buch prescriptions hre filed and said fee is paid In conformity with the law of the State of Utah, this ordinance shall not bo construed to require tho filing of additional prescriptions pre-scriptions or the payment of any additional fee. No prescription shall bo refilled nor shall more than eve quart bo furnished on one prescription. prescrip-tion. Nothing In tills ordinance shall be construed to-prevent .druggists or registered pharmacists from furnishing furnish-ing or selling intoxicating liquors in wholesale quantities to registered pharmacists, to public or charity hospitals, hos-pitals, to medical or pharmaceutical colleges, or, to scientific schools or Institutions. Illegal sales by druggist. No druggist or other person within Logan Lo-gan City shall sell, dispose, of, or glvo away any proprietary, patented or compound medicines, classed by tho United Sthtes Commissioner of Internal Itovcnuo as an intoxicating liquor insufficiently medicated to render ren-der them unsultablo as bovoragos, except upon tho prescription of a licensed and practicing physician of tho otato of Utlih, 437. Sales for sclentlflc purposes, emergencies. Nothing In this ordln- nnce shall prohibit tho salo by licensed licen-sed pharmacists or wholesalo druggists drug-gists within lxigon City of alcohol for art, science, or mechanical purposes or wines to church officials for sticra-mentnl sticra-mentnl purposes A record of such sales for said purposes shall be made and preserved In a book for Hhat purpoie, signed by tho person receiving tho same, which record shall be open to public inspection. No druggist or licensed pharmacist shall within Logan City, sell, exchhngo, barter, glvo away, 0r otherwise furnish furn-ish any intoxicating liquors except ns herelnbeforo stated. 439. That section 439 of tho Revised Revis-ed OrdInanc.es of Logan City, 1912, Is hereby amended to read ns follows: Nuisances. What aro. All places in Logan City whero intoxicating liquors are manufactured, sold, bartered, given giv-en away, or otherwlso furnished in violation of this ordinance, or whero persons nro permitted to resort for the purposo of drinking Intoxicating liquors as a beveiirgc, sold In violation viola-tion of this ordinance or whero Intoxicating In-toxicating liquors are kept for sale, given away, or otherwlso furnished in violation of this ordinance, and nil intoxicating liquors, bottles, glosses, kegs, pumps, bars and other pcopor-ty pcopor-ty kept in nmd used In maintaining such places aro hereby declared to bo nuisances,, nnd every person who raalntarnafcor assists In maintaining such -a nulsanco shall be guilty of a misdemeanor, 440l Words. Defined. The term, "person" as used In this ordinance shall Include association, co-partnership, 'club hnd corporation and the singular shall include the plural and the plural tho singular; and tho masculine mas-culine shall Include tho feminine. . -44ll Id. The term "Intoxicating liquors" as used In tills ordinance, 'shall bo construed to mean any splr-ltous, splr-ltous, vinous, malt and fermented liquors liq-uors that may bo used as ti bevcrago and produce Intoxication, and all preparations pre-parations and compounds thereof that may be used as beverages and prod-uco prod-uco Intoxication. 442. That Section 442 of tho Revised Revis-ed Ordinances of Logan City, 1912, is hereby amended to read as follows: fol-lows: Penalty.
