May 10 Four out of flvo motions to strlko from the record re-cord parts ot the testimony offered In behalf of Theodore Roosevelt wero donled in the supreme court here today. to-day. Tho motions wero made by counsel for William Barnes in his llbol suit against Colonel Koosovelt, after the dofenso had rested Its case. That part ot former State Senator Georgo D. Agnow's testimony which had to do with tho oloetlon of J. P. Allds ns president pro tem, of tho state senate was stricken from tho rocord. The court ruled that thoro uas nothing to show that Mr. Barnes was In any way concerned In tho al-loged al-loged combination between tho Ko-publlcan Ko-publlcan and Democratic machines. Mr. Agnow's testimony, which had to do with Agnow Hart race track bill, was allowed to stand, to tho effect ef-fect that State Senator Grattan at the bidding of Mr. Barnes, vctod against the bill after ho had promised promis-ed to support It. His ono vote caused caus-ed tho bill to fall of passage, it wau said. Justlco William S.
