Show AN ORDINANCE An Ordinance Granting a Franchise to the Logan Rapid Transit Company, Com-pany, a Corporation, Its Successors, Lessees, and Assigns, For The Construction Con-struction and Operation of a Railroad Rail-road Within Cache County, 8tate of Utah. Tho Board of County Commissioners Commission-ers of Cache County, State of Utah, ordains as follows: Section 1. That thcro' bo and hero-by hero-by Is granted to tho Logan Rapid Trnnsit Company, a corporation, its successors, lessees, nnd assigns, a franchise to coustruct nnd operato a continuous line of railroad by electric or gasollno power, together with nil switches, sidetracks, spurs, and polo lines necessary or convenient for the construction or operation thereof, for tho transportation of passengers, freight, express, or mail matters, over and upon tho public highways and roads of Cache County", moro particularly particu-larly hereinafter doscrlbcd, outsldo of the limits of Incorporated cities and towns thereof. Tho said company shall hnvo tho right to erect n line of poles to support, telegraph, telephone, tele-phone, trolley, or transmission wires, nlong such highways and roadB within Cacho County for tho purpose, of operating oper-ating said road. Tho nforesald franchise fran-chise Is grnnted over and upon tho following described highways of Cache County, to-wlt: Commencing nt tho Intersection of eighth East Street and the northern boundary of I.ogau City nnd extending extend-ing along tho eaBt side of tho Logan. Lo-gan. Greenvlllo nnd Hyde Park County Coun-ty Road to n point on tho Southern boundary of tho Town of Hyde Park. Also commencing on tho northern boundary ot tho Town, of Hyde Park whero said northern boundary crosses that certain street running north and south through tho said town one block west of the Public Square of said town, and running thenco north along tho west side of said street 2030 feet moro or less to a certain street running runn-ing westerly along the north Bldo of of the last named Btreet to the Stato Road, thenco northerly nlong the cast sldo of tho said Stato Road to tho Southern Boundary of Smith-field Smith-field City. Also beginning nt tho southern boundary of Lognn City near the Logan nnd Providence Logan River Bridge, and extending thence on n southerly direction nlong tho I west side of tho road leading to thoj town of River Heights, to the southernmost south-ernmost enst and west street of said town, thenco nlong the south sldo of tho lust nnmed street to the County Road leading to tho town of Providence, Provi-dence, thenco south nlong the right sldo of said County Road to tho Town of Providence all In Cache County. Utah. Section 2. Said railroad shall bo constructed and operated In such manner so ns to present the least poi- slblo obstruction nnd Inconvenience) to tho traveling public and ample provisions shnll bo mado for tho free and unobstructed flow of wnter cours- ' es now existing, nnd all boxes and , culverts which may bo required shall . bo substantially constructed and i maintained In good condition by the said grantee, Its successors, losseea i nnd assigns. Tho track, switches, sldo-trncks, and spurs, shall bo laid era mnintnincu on tne grnuo ugrueu upon by tho Board of County Commissioners, Com-missioners, nnd good und substantial crossings shall be mado und maintained main-tained by Bald grantee, Its successors, lessees and assigns nt tho Intersection ot all public and privnto streets, alloys al-loys nnd highways nnd crossings nt all other points whero necessary and prescribed by tho said Board of County Commissioners. Nothing In this franchise contained shall provent Cneho County from laying gas or water mains, or altering or repalrng In nny manner tho portion of tho highways used by tho said grantee, Its successors, lessees, nnd assigns but nil such improvements shall bo mado with ns llttlo injury to tho railroad rail-road or polo lines ns possible, nnd only nfter reasonable notice, not exceeding ex-ceeding thirty (30) dnys, and the said grantee, its successors, lessees, or assigns during tho prosecution of any such work shall havo the right to lay temporary tracks If necessary. Soction 3. Modern Improvements used In tho operation of railroads for tho convenience, comfort and safoty of passengers nnd tho employees of said railroad shall bo adopted and used, nnd cars shall bo run and oporatcd thereon nt regular Intervals, Inter-vals, both ways, each day during the life ot this franchise, and tho said grauteo, Its successors, lessees nnd assigns, ohall at all times, both In the construction 'and operation of Bald railroad, bo Biibject to and conform with nil rcasonablo rules and regulations regula-tions established by tho said Board . of County Commissioners. Section 4. Said grauteo, Us succes sors, lessees nnd nsslgns shall hold Cacho County harmless from any and all damages which any person or corporation cor-poration may suffer in the construction construc-tion or operation of said railroad through tho fault, neglect or misconduct miscon-duct of said grantee, Its successors, lessees, or nsslgns, provided, however, Hint it a claim Is filed or an action Is brought for the recovery of damages aforesaid,. against Siald Cacho County, tho said Cacho County shall glvo grantco notice In writing within flvo days after tho filing of said claim, or of tho said action brought, beforo tho said grantee shall bo responsible for tho damages mentioned In this section. sec-tion. Section C. Tho grantee heroin, Its successors, lessees or assigns shall commence tho actual construction it the said railroad within threo (3) months after tho passage of this ordinance, or-dinance, and shall build, construct, and operate said railroad within one year from tho dato of tho passago of this ordinance, nnd said rights and privileges heroin granted shall bo declared de-clared forfeited by Bald Cacho County Coun-ty and become null and void, unless said railroad shall bo commenced, constructed, nnd completed at tho time, In tho manner and within tho terms nbovo set forth; provided, how-over, how-over, that If tho said grantee, Its successors, suc-cessors, lessess, and nsslgns shall be hindered or delayed In tho construction construc-tion of Bald railroad by condition? over which grantee has no control, then the tlmo during which grantee Is so hindered or delayed shall bo added to tho tlmo heroin specified. Provided further that It this franchise bo not accepted In writing by said grantee within ten days nfter Its passage, then tho name shall become null and void and of no force or effect. Section 6. Cache County reserves the right to regulate and control the ' speed of all trains, engines, nnd cars operated by said grantee, Its succcs- : sors, lessees, or assigns on said rail-. road. Section 7. That tho poles for thoi carrying of telephone, telegraph, trol-' ley or transmission wires, shall bo of such sultablo slzo and shape and plnccd at such places as indicated by tho Board of County Commissioners. It Is distinctly understood that Cache County Bhall havo tho right to uso any and all of tho poles erected by tho grantee herein, Its successors, lessees or assigns for the purposo of placing thereon wires for such purpose pur-pose ns It may desire, the samo not , to Intcrfcro with the use of said j poles, by said grantco. Section S. Said grantee shall exc cute nnd deliver to Cache County n good and sufficient surety bond In tho sum of fSOOO.OO conditioned fo( tho faithful performance of tho commencement com-mencement nnd completion of said railroad according to tho terms ol this franchise, nnd upon the faithful performance ot tho terms of this franchlso tho said surety bond shall becomo null and void, otherwlso to icmaln In full forco nnd effect. , The County Commissioners reserve tho right to locate tho particular part ot tho side of tho roads upon which ' ' tho said railroad shall bo built as I 1 herein granted. That whenover said grantor shall find It necessary or dcslrablo to grant ' to any other railroad company or ' ' person a franchlso over any ot the ' hlghwas of Cacho County, the' grantee herein shall allow such other' railroad company or person running arrangements across grantee's tracks whoro tho said gruntco's track Intersects In-tersects with that ot said other railroad rail-road company or person, upon such other company or person making equltnblo payment for construction and maintenance and operation ot the portion ot said granteo's track bo used. Section 9. For tho construction of said railroad steam power may bo used, or for tho removal of wreckage or In caso that the electric or other motor power may bo temporarily disabled. dis-abled. Section 10.' Tho rights -herein granted shnll exist nnd lnuro to the benefit of tho said grantee, Its successors, suc-cessors, lessees, or assigns for a period of fifty years. Section 11.
