Show January 14 Deadline For Filing Briefs In Condit Case The attorney for John Lawton Condit, sentenced to die for the mnrripr nf TTnrnlH A Thnrne last March 20 near Cedar City, has been granted until January 14 by the supreme su-preme court to file briefs on appeal. Condit was convicted of first degree de-gree murder in the 5th. Judicial District Dis-trict Court last June and sentenced by Judge Wll L. Hoyt to face the firing fir-ing squad on August 1. Condit's attorney, at-torney, John Moore Williams of Milford, immediately filed notice of appeal and on September 8, 1941, the transcript in the appeal was filed with the Supreme Court. Since that time, Williams has obtained four extensions of time in which to file his brief, the last date set being December 5 at which time no brief was filed and no further extension obtained. Last week the court ordered or-dered Williams to appear on Monday of this week and show cause why i the appeal should not be dismissed. I Should a brief be filed on January Janu-ary 14, the case probably cannot be heard until the March term of court, as the attorney general has 20 days after the defendant's briefs are filed in which to submit his own. in the meantime, Condit is confined to the Utah State Prison near Snlt Lake City. |
