It shall be unlawful 0 sell or dipsose of or offer to s,ell or dispose of or have in oije's; possession for sale or barter, any fruit which is or has beei in fected with San Jose sca'je, or other scale insects, or the larvae of tlie codling moth, r.nd tho fact that such fruit b earn tho mark of any scale, or js vorm eaten by the larvao ol tho codling cod-ling moth shall be deemed conclusive con-clusive evidence tlrat fruit is infected in-fected within the meanin g of this section; and the state and county inspector and the deputies dep-uties are hereby given pav er to seize and destroy such in ected fruit whenever they shall find that tho same has been p. .eked, sold, shipped or offered foi sale, or where tho same has boe n ox- HaBaHHg posed for sale, or is being heldlj in any warehouse, store, sales-1 rooTi or other place for-ho-pjiTM pose of being sold, bartereJi shipped or exposed for sale or) bartered'; and it is hereby madd tho duty of saict state iospectoj and said; county inspectors ai) deputies to enforce the provisions pro-visions o this section, and any person who shall violate the provisions pro-visions of this section shall bo guilty of a misdemeanor; provided, pro-vided, however, that any qualified quali-fied inspector or deputy shall immediately im-mediately upon being notified inpsect a ny shipments of fruit, and issu'e certificate for release or inspection. Provided further, fur-ther, that nothing in this secr tion shall be construed to prevent pre-vent the utilization of such infected in-fected fruit in the manufacture of frruit bs'-products where said fruit has not been packed, sold shipped, stored or offered or exposed, ex-posed, for sale. as fruit. , |
