meeting place of said city council in the city hall in the city of green river utah due legal and timely notice of said meet ing having been served upon all members as required by law and the rules and ordinances of said city on roll call the following mem bers constituting a quorum were present mayor dever curtis councilman albert J may councilman lauren beebe councilman kenneth N Sf fliman also present city recorder weltha thompson absent councilman james hurst the meeting was called to order by mayor devere curtis presiding after reading of the minutes and conducting other business not per taming hereto councilman kenneth N saliman introduced the following ordinance and moved its adoption which ordinance was read in full and follows ordinance 72 B an ordinance providing for the iss vance and sale of the negotiable cou pon bonds of the city of green river emery county state of utah in the following amounts thirty thousand dollars 30 00 bo ards ten thousand dollars 10 00 sewer system bonds whereas by the result of a special bond election duly and lawfully call ed and held in the city of green ri III ver emery county state of utah en on thursday the day of june 1955 the city of green river utah was empowered to issue and sell its negotiable capon pon bonds as foil foll aws to the amount of thirty thou sand dollars 30 00 for the pur pose of defraying the expense of improving enlarging and extending the waterworks plant and system in the city of green river to more adequately provide said city and the inhabitants thereof with sufficient cent water which waterworks plant and system shall be owned and contrell con troll ed by said city and to the amount of ten thousand dollars 10 00 for the purpose of defraying the ex pense of increasing improving en barging and extending the present sewer system and works of the city of green river including outfalls and disposal facilities for the pur pose of more adequately supplying said city and the inhabitants thereof with sewers which said sewer system and works be owned and controlled by the said city and whereas the result of said elec tion was declared by the city cou neil of said city sitting as a board of canvassers by resolution duly passed on the day of june 1955 from which it appears that a maj onty of the qualified fed electors of said city who are taxpayers thereof vo ting at said election were in favor of the issuance of said bonds to the amount and for the purposes above set forth and whereas the city council of the city of green river deems it lent and necessary at this time to issue and sell all of said forty thou sand dollars 40 00 bonds so authorized now therefore be it ordained by the city council of the city of green river emery county state of utah section I 1 for the purpose of de fraying the expense of improving enlarging and extending the water works plant and system in the city of green river to more adequately provide said city and the inhabit ants thereof with sufficient cent water which waterworks plant and system shall be owned and controlled by the city there shall be issued thirty thousand dollars 30 00 city of green river emery county state of utah waterworks bonds series of october 1 1955 dated october 1 1955 in the denomination of one thousand dollars 1000 00 thirty 30 both inclusive bearing interest at A the rate of three per cent 3 per annum from date until paid interest payable semi on the first day of april and october in each year commencing april I 1 1956 which bonds shall mature wi with th out option of prior payment pay to the bearer hereof the sum of ONE THOUSAND DOLLARS 1 00 on the first day of october A D 19 without option of prior pay ment with interest there upon at the rate of three per cent 0 3 per annum payable semi annually on the first day of april and the first day of october in each year commena ing april 1 1956 upon presentation and surrender of this bond and the attached coupon as they severally become due both principal and in terest being payable at the office of the city treas treasure re in the city of green river utah in lawful money of the united states of america this bond is one of a series of thirty 30 bonds of like date and amount known as the city of green river waterworks bonds ser ies les of oct october 0 ber 1 1955 and is issued for the purpose of defraying the ex pense of improving enlarging and extending the waterworks plant and system in the city of green river to more adequately provide said city and the inhabitants thereof with sufficient water which waterworks plant and system shall be owned and controlled by said city under and by virtue of and in full conform ity with the constitution and laws of the state of utah and an ordinance duly adopted and made a law of said city prior to the issuance of this bond the city council of said city of green river shall annually levy a tax sufficient to pay the interest on this bond as it falls due and also to constitute a sinking fund sufficient to pay the principal when due it is hereby certified recited and declared that all conditions acts and things essential to the validity of this bond exist have happened and have been done and that every requirement of law affecting the issue thereof has been duly complied with and that this bond is within every debt and other limit pr prescribe escrib edby the constitution and laws of said state and that the full faith and credit of said city of green river are hereby irrevocably pleda ed to the punctual payment of the principal and interest of sign and attest and affix the seal of the city to each of said bonds and the sets of said mayor said city treasurer and said city recorder in so doing are and shall be the act and deed of the city of green river utah all the covenants statements represent ions and agreements con tamed in said bonds and coupons and all the recitals and represent aliens of this ordinance are hereby considered and understood and it is hereby ordered and declared that said covenants and promises therein are the covenants and premises of the city of green river and that the representations and statements therein are the representations of said raid city section 4 that to pay the interest falling due on said bonds on april 1 1956 and thereafter as the same becomes due and also to provide a sinking fund for the payment of the principal of said bonds at m maturity there shall be levied on all taxable property in said city in addition to all other taxes a direct annual tax sufficient to pay the interest on said bonds and to pay and retire the same as herem hereinbefore before provided said taxes when collected shall be applied sole ly for the purpose of the payment of said interest and principal of said bonds respectively and for no other purpose whatsoever until the indebtedness so contracted under this ordinance principal and inter est shall have been fully paid sat isfried and discharged but nothing herem herein contained shall be so con as to prevent said city from applying any other funds that may be in the city treasury and avail able gable for that |
