Bo it ordained by tho City Council of Salt Lake City, Utah: Section 1. A franchlse.and right-of-way is hereby given and granted to Tho Denver and Rio Grando Railroad Company, and to Its successors and assigns, as-signs, to lay, construct and operate a spur standard gauge railroad track upon up-on tho street hereinafter mentioned, to-wlt: Beginning at a point In tho center of tho track of The Denver and Rio Grando Railroad Company along tho center of Sixth "West Street about 300 foot south of tho Intersection of tho center lines of S xth "West and First South Streets In Salt Lake City, and running thence with a single track curving In a southwesterly direction across tho west half of Sixth "West Street to the oast side of Lot 1, Block 47, Plat "C," Salt Lako City Survey, at a point about 210 foot north of tho southeast corner of said Lot 1, said spur being delineated by yellow curved lines on tho bluo print map hereunto annexed and mado a part hereof. Section 2. During tho term of this franchise, tho grantoo shall bo sub t to tho following conditions, viz: (a) That said spur track shall bo laid upon and conform to tho established estab-lished grade of said street, and If said grade is afterwards changed by ordinance ordin-ance of tho City Council, tho grantee shall, at its own expense, change the elevation of the track so as to conform to tho same. (b) "Whenever said street where such track Is constructed shall bo paved, pav-ed, then said grantee, its successors and assigns, shall pavo between tho rails and for a space of two feet outside of each rail, with tho same material as that used In tho streot pavement, and all ties shall bo laid upon a concrete con-crete base of such thickness as shall bo directed by tho City Engineer. (c) Said grantee shall put In and maintain such crossings over said sour track as shall from time to time b required re-quired by tho City Council. Neither cars nor engines shall bo permitted to stand in said Sixth "West Street longer than five minutes. (d) Tho said spur track shall bo laid, and tho road operated, so as to cause no unnecessary impediment to tho common and ordinary use of said street UDon which It is laid. (e) Good and sufficient conduits to convoy water shall bo laid and maintained main-tained in good condition at the expense of said grantee In all tho water ditches crossed by said spur track, so as to admit of free passago of water. (f) Sa'd grantee, its successors or assigns, shall gravel and maintain In good condition, at the established grade, the street along which the track runs for a distance of twenty-five foot on each sldo of tho outer rail, subject sub-ject to tho approval of the supervisor of streets. (g) Salt Lako City reserves tho right to regulate and control the speed of all trains, engines and cars operated by tho grantee, its successors or assigns, within tho city. Section 3. Nothing In this grant shall be construed so as to prevent Salt Lake City or Its authorized agents, contractors, person or corporation to whom a franchise may have been or may hereafter bo granted, from paving, pav-ing, sewering, laying gas or water mains or pipes, altering, repairintr, ot 'n any manner improving said street, but all such Improvements shall be mado with as little injury as practicable prac-ticable to said spur track and tue operation oper-ation thereof. Section A. Tho said grantee herein. Its successors and assigns, shall, and by tho acceptance of tho privileges and franchises heroin granted, and In consideration of tho same, does bind Itself, Its successors and assigns, upon Its acceptance of this franchise, to savo said city harmless from all suits claims, demands and judgments whatsoever, what-soever, whether In law or In cqtiltv, which shall bo asserted, found or rendered ren-dered In any manner whatsoever, againnt said city for injurv or damage to abutting property or otherwise. reason of tho granting of this franchise fran-chise or by reason of tho operation of said spur track; and that tho grantee . herein, its successor's and assigns, will nay tho amount of any Judgment, determination de-termination or adjudication which, in any su't or proceedings may or shall bo found against Salt Lako CItv; provided, pro-vided, however, that said grantee its successors and assigns, shall have had notlco of any such suits and an opportunity oppor-tunity to appear and defend the same; and said granteo, its successors and assigns, as-signs, shall appear in and defend all ictlons brought against Salt Lake Cltv for any Injury or damage bv reason of the construction, operation or maintenance mainten-ance of said spur track. Section 5. This franchise Is granted for a period of twenty-five years from nnd after tho approval of this ordinance. ordin-ance. Section C. Unless this grant and nil the terms and conditions thereof shall be accepted in wrltg by tho granteo herein within thirtv days from tho ap- s' proval of this ordinance, and unless said tracks bo constructed within one year from tho date of such approval, then this ordinance shall bo null and void.
