Show Sixth District Court Actions: PANGUITCH Judge David L. Mower presided over Sixth Judicial District Court on Thursday, Thurs-day, May 29. Suzanne Callies, 26, Panguitch Pan-guitch made an initial appearance in court on a single count of issuing a bad check, a class A misdemeanor, in January. She was not represented by counsel and asked if she would be allowed to continue pay on the amount owed. Garfield County Wallace Lee said he felt he had "bent over backwards" prior to court to settle the matter but was no longer willing to settle. Judge Mower ordered Callies to report for fingerprinting to the Garfield County Sheriffs Office and advised her to obtain an attorney before reporting back to court on June 12. Ronnie C. Davenport, 23, Panguitch, was brought from the county jail to court for a review of his case. Davenport had been jailed for a period of 30 days by Judge K.L. Mclff, awaiting information infor-mation on an alcohol treatment program or, alternatively, a term at the Utah State Prison. Lee, agreeing with the state's assessment, recommended prison as necessary, while Davenport's attorney, Dale Williams of Tropic, argued for strict confinement, confine-ment, counseling, and treatment. The judge agreed with Lee and imposed the statutory sen tence of 1-5 years in prison on the defendant with fines of $9,250. He then the sentence and fines, placing Davenport under three years probation with Adult Probation Pro-bation and Parole and ordered him to serve a year in the county jail with credit for time already served. His case will be reviewed on Oct. 2. He was also ordered to complete and pay for a recognized alcohol treatment pro--gram, maintain full time employment employ-ment as possible and disassociate himself with those who drink alcohol. The judge reserved the right to look at payment of fines at a later date. Richard Allen Rhines, 37, of Escalante was represented by Public Defender Floyd Holm' in a review of his drug-related case stemming back to his arrest in February. In a plea bargain, Rhines pleaded guilty to two out of the five initial counts with which he was originally charged. In exchange, all other counts against him were dismissed as well as all charges against his arrest companions Joe Sidwell and Darrel Layne Stowe, both Escalante. Amended charges against Rhines included a single count of possession of five ounces of methamphetamines with the intent to "drop it off to another (See Sixth District Court Actions On Page 3A) Sixth District Court Actions On May 29 From Front Pasze individual to which Rhines pleaded guilty. The crime is a 2nd degree felony and includes a demand for forfeiture of the vehicle used in the commission of the crime. On Feb. 14, Rhines was parked in his 1975 Overlander motorhome at the time of his arrest. The vehicle, with an estimated esti-mated value of $10,000 was forfeited to the IronGarfield Counties Narcotics Task Force. The defendant was still on release on his own recognizance. A presentence pre-sentence report was requested and sentencing set for July 10. The case of the state of Utah Vs. Neil Arthur Sawyer, Panguitch Pan-guitch was set for a preliminary hearing but the case was vacated on a stipulation to continue. The preliminary hearing was reset for June 12 with a plea bargain pending. pend-ing. Jamison Culley was set for a sentencing hearing represented by Attorney Michael Sikora. Culley had been charged with multiple counts relating back to an incident where he attempted to elude a Utah Highway Patrolman by turning off the lights of his vehicle and leading the officer on a chase. Lee concurred with the recommendations of APP that this was a "stupid act," irresponsible and reckless. The state recommended recom-mended prison time. Judge Mower Mow-er imposed the statutory sentence of 1-5 years and subsequent fines. He then suspended the prison sentence and committed Culley to the Garfield County jail for 90 days, to be followed by 24-months probation. Judge Mower will review his case July 21 and anticipates releasing Culley if a treatment program is identified. |
