Show 6th District Court Scott To Serve 45 Days In Jail Judge David Mower handed down a 45-jail sentence to 26-year-old David Mitchell Scott of Cedar City when he appeared for sentencing sentenc-ing in Sixth District court in Panguitch on March 30. Scott had earlier entered a guilty plea to one count of issuing bad checks, a second sec-ond degree felony. He was also ordered to pay $1,850. in fines and restitution of $1,125. Represented by Garfield County Public Defender Kent Winward, Scott was ordered to begin be-gin his sentence in the Garfield County jail on April 5 to allow for his appearance in Salt Lake City Third District Court on April 4 on charges there. The outcome of that appearance was unavailable at press time. Scott is also facing three second sec-ond degree felony forgery counts involving checks written to Albert-sons Albert-sons and Lins in Cedar City on Dec. 10 and 11, 1994. A preliminary prelim-inary hearing is set for Scott on Apr. 18 in Fifth District Court in Cedar City. The Panguitch charges against Scott originated with checks written to the Roundup and Leland's Chevron written Nov. 10 through Dec. 5, 1994. He was initially charged with four second degree (See David Mitchell Scott Sentenced Sen-tenced To 45 Days on Page 4A) Scott Sentenced From page 1 felony counts and nine third degree felony counts of forgery involving 13 checks. He was also charged with one count of issuing a bad check, a second degree felony and one count of theft by deception, also a second degree felony. When he appeared in court on Feb. 2, under un-der a plea agreement, all charges ex- cept the second degree felony bad check charge were dropped. Scott pleaded guilty on that charge. Garfield County Attorney Wallace Lee prosecuted the case. Judge Mower told the court he will review Scott's sentence on April 27. He also placed Scott on 36 months probation, ordered him to confess to his family, obtain mental health counseling, and refrain from holing a checking account during his period of probation. Shon Lcavitt, was arraigned on a class B misdemeanor assault charge . In a diversion agreement with the court, he was ordered to pay his victim S125, pay court fees of $200 and to make no violation of the law for two years. Harold Dreycr, 25, Salt Lake City, was arraigned on two second degree felony counts. He is charged with escape from the Garfield County jail Oct. 9, 1994, a crime punishable by 1-15 years in prison and fines up to $18,500. He is also charged with theft of a vehicle. Garfield County Attorney Wallace Lee said the state has at least five witnesses. Dreyer was serving 10 years for aggravated sexual assault when he escaped. He had been transferred four months earlier from the Utah State Prison at oint-of-thc-Moun-tain under the slate's program which places state prisoners in rural county jails to relieve overcrowding. |
