Show Panguitch Man Gets Jail In Sheep Theft Van Barney, Panguitch, will serve a 30 day jail sentence on weekends so that he can retain his present employment, and will pay a total of $1,299 in fines after he pleaded guilty to a third degree felony charge and a class B misdemeanor in the Sixth District Court in Panguitch on January 8. Barney was charged with the crimes during the elk hunt in October when Conservation Officer Brent Christensen, Circleville, arrested Barney, who was accompanied by a youth, on suspicion of theft of some sheep belonging to Paul and Blaine Smith of Beaver. Christensen had observed Barney in an elk hunt area and stopped him for routine questioning in the Big Dog Valley area. He noticed two dead sheep in Barney's pickup and subsequent follow-up by the Garfield County Sheriff's office, Jeeps Posse members, and Panguitch City Police resulted in his arrest. Judge Don V. Tibbs sentenced Barney to 0-5 years in state prison and a $5,000 fine for the felony theft charge. He suspended the prison sentence and $4,000 of the fine. On the misdemeanor, contributing to the delinquency of aminor, Barney was sentenced to six months in prison and fined $299. Judge Tibbs reduced the sentence to 30 days in the county jail to be served on weekends, during which time he will be on probation. |
