Show NO: i EOF TRUSTEE'S SALE. Whereas, Charles August Allen and Elon L, Allen, his wife, of Utah Countv, Utah, executed, exe-cuted, acknowledged, and delivered to James H. Bacon, truste-?, their certain trust deed, bearing date tne first day of December. A. D. 1890, which said trust deed was recorded in the recorder's office of Utah County, Utah, in Book "8" of Trust Deeds, on paires 228, 229, 230 and 231 of the reoords cf said office, and given to secure se-cure tho payment of Twenty-two Hundred Dollars, as evidenced by a certain first mortgage bond or note, bearing even date with said trust deed, and payable on the first day of December, A. D. 1895, with interest thereon at the rate of eight per cent, per annum, an-num, payable semi-annually, as evidenced by ten interest coupons to said first mortg .ge 'jond or noe attached, and which said trust deed was given upon the following described Premises, situated in the County of Utah and erntory of Utahtto-wit:;commencngtwenty-(20) chains north of the southwest corner of section sec-tion twenty-nine t2U) township eight (8) . south of range two (2), east talt Lake meridian; thence east twenty (20) chains; thence north ten (10) chains: thence west twenty J20 chains; thence south ten 1101 chains to the place of beginning. be-ginning. Also one-fourth of the water in the Pond "own Slough, together with any and all water rights owned by the said Charles August Allen and Elon L. Allen, or either of them, or belonging to or with or used upon said premises, or any part thereof-. And Whereas, it' is provided in said trust deed among other things that in case default be made in the payment of either of said notes, indebtedness, or moneys secured bv said trust deed, or of the tares or assesssmenta on said E remises or any part thereof , or in case of the reach of any of the covenants in said trust deed contained to be kept and performed by the said Charles August Allen and Elon L, AHen. then to sell and dispose of said premises, prem-ises, or any part thereof, and said water rights, together with all the right, title, benefit bene-fit and equity of redemption of the said Charles August Allen and Elon L. Allen, their heirs and assigns therein forever, either in mass or in separate parcels, as the holder or holders of said bond and notes may prefer, at public auction, at the front door of tje Court House in the County of Jtah and Territory of Utah, or on said premises, as roav bo specified in the notice of such sal for tho highest and best price the same wi'l bring in cash, after first giving tnirty days urevious notice ot such sale by publication in any newspaper at that time published in the said County of Utau.and to make, execute, acknow'edge and deliver to the purchaser or purchasers at said gale good and sufficient deed or deeds of conveyance for the premises sold. And Whereas, it is aiso provided in said trust deed, among other things, that in case default be made in the payment of any or either of the indebtedness or moneys secured thereby whether of principal or interest, or (f the breach of any of the coven ints in said trust deed contained, to be kept and performed bv the said Charles August Allen and Elon L. Allen, then any and all of the moneys thereby there-by secured Shall upon such default, at the option of the holder ot said indebtedness, become be-come immediately due and payable, anything in said trust deed or in eaid bond or notes contained to the contrary, notwithstanding. And Whereas, Charles August Allen and Elon L. Allen have both and each made default in the payment of the interest on said indebtedness, dueon the first day of December, A U. 893: on the first day of June, A. D, 18i;and on the first day of December, A. I). 1S94; Hnd Whereas, the legal holder of said indebtedness indebted-ness has declared the wbole ot said indebtedness indebted-ness to be now immediately duo and payable and requested said trustee to advertise and sell said premises and water rights, pursuant to the power and authority in him vested in and by said trust d eed ; and w hereas, it is also nrovidsd in said trust deed that in case ot the death, absence from said Ctah County, inability or refusal to act ot the said James H. Bacon, that then Harvey M. Bacon shall be and is by 8'iid trust deed appointed and made succpssor In trust to said James H. Bcon.with like powers pnd authority, author-ity, aud said premises thereupra becomes vested in saia successor in trust, for the ues and purposes In said trust deed mentioned; and Whereas, sa'd James II, Bacon is absent from said Utah County, unable to and refuses to act in the premises. Now theretore public notice is hereby given that I, Harvey M. Bacon, successor in trust as aforesaid, will on Thursday, tne 21st day of February, A.D. 1895. at ten o'cloc a m. of said day at the north frontdoor of the County Coun-ty Court House in the City of Provo. in Ctah County, Utah, sell at public auction to the highest and best biddpr for cash, said premises prem-ises and watfr rights hereiubelore described, together with all the right, title, benefit and equity of redemption of the said Charles August Allen and blon L. Allen, their heirs and assigns therein forever for the purpose of paving said indebtedness and Interest thereon, there-on, and the costs, attorney's fees and expenses of executing this trust, and will make, execute, exe-cute, acknowledge and deliver to the purchaser pur-chaser cor purchasers at said sale, good ana sufficient deed or deeds of conveyance for the premises sold.
