The peome of the territory of Utah send greeting to Johan Daubcnder, defendant, l'ou are hereby required to appear in an action brought against you by the above named plaintiff, in tho aistrict court of the First J udicial District of the territory of Utah and to answer the complaint filed therein, within ten days exclusive of the day of ser- i vicel after the service on you of this summons if seryed within this county ; or if served out pf this county, but in this district, with in twenty days; otherwise within forty days or judgment by default will be taken against you, according to prayer of this complaint. The said action is wrought to obtain a judg mentof this court dissolving the bonds of matrimony now existing between plaintiff and defendant and for costs of suit. Plaintiff alleges that plaintiff and defendant Intermarried at Nurnberg, Germany, on or about the 30th day of .August, 187B, and ever since have teen und now are husband and wile; that the ulaintiff Is. and has been a resident resi-dent of Utah territory, for more than one year proceeding the commencement of this action. The defendant for more than five years last past has failed to provide plaintiff with the common necessaries of life. The defendant, de-fendant, disregarding his duties asahusbandr has been guilty of habitual intemperance. For f uller particulars reference is hereby made to plaintiff's complaint on file herein.
