THE TRUTH WILL APPEAR As to Whether Mr. Hague is or ia Not a Criminal He Pleaded Not Guilty Before Be-fore Judsre Merritt Today Other Business Busi-ness Transacted in . the First Didtrict Court. The woman, Rachel Day is of Payson, tried in the First District court yesterday yester-day on a charge of adultery, alleged to have been committed with one Charles M. Patten, also of Payson, waa acquitted ac-quitted by the jury, who heard the eviderce. The charge of adultery against Charles M. Patten, once ignored by a grand jury, was ordered resubmitted. Trial of Herman Burmester accused of embezzling a check the properly of a butcher firm in Eureka, was concluded. The jury acquitted Mr. Burmester. Tiie case against Charles R. Whitehead White-head indicted for grand larceny, stealing steal-ing a horse belonging to Ee Grand Young of Salt Lake city, was ordered transferred to the Third District court. The case of the United States vs. James Wall of Sevier county, accused oi fornication, was dismissed upon motion mo-tion of the'prosecuting attorney on the grounds of lack of sufficient evidence to convict. Chief Justice Merritt was upon the bench to hear arguments on the demurrers demur-rers to the Alma Hague indictments, fourteen in all, nine for making false entries, four for misapplication of fund?, and one for embezzlement. Sam. A. King of Provo and Judge Henderson Hender-son of bait Lake appear for Mr. Hague. Judge John A. Marshall, special counsel coun-sel employed by the government to assist as-sist Judge Judd in the prosecution ol these cases, whs present in court and assisted the public prosecutor in the arguments against the demurrers. Judce Merritt overruled the demurrers demur-rers to all the indictments and Alma Hague stepped up and pleaded not guilty to all of the indictments. Court was then adjourned till tomorrow tomor-row morning at 10 o'clock. |
