Show First District Court. " The time of the Firet District court yeeterday afternoon was taken up in hearing evidence in the suit brought by Richard Brereton, receiver for the old defunct Sun Foundry of Provo, aeainst the stockholders of that enterprise enter-prise to compel them to pay up all un paid stock in behalf of the creditors of the corporation. At adjournment time a motion for nonsuit was made by the defense, and this was taken under advisement ad-visement until this morning. This morning Judge Smith sustained the motion for nonsuit and the case was dismissed as against all the de fendantB. The time is being occupied in hearing evidence in the case ot Albert M. Carter Car-ter vs. John A. Brown et al, suit to restrain re-strain the sheriff from the Whipple property on Provo bench under an ex ecution in his hands, plaintiff alleging that the property belongs to him and not to Whipple. |
