Notice to Public Request for Comments Disadvantaged Business Enterprise (DBE) Goal Pursuant to CFR 49 Part 26, the Utah Department of Transportation (UDOT) has developed a proposed Disadvantaged Business Enterprise (DBE) Goal in its Federal-aid Transportation Programs. UDOT has established a 45 day comment period. Comments must be in writing and must be received no later than November 5, 2008. Proposed DBE goals have been established for the year 2008 which narrowly tailors the DBE goals to the local market. The goal setting procedures and calculations are a part of the proposed DBE Program information. The proposed overall DBE goal for Federal Highway Administration (FHWA) funded projects is: 9.0%. The anticipated race conscious DBE goal is 0.0%. The anticipated race neutral portion of the DBE goal is 9.0%. The proposed DBE goal for Federal Aviation Administration (FM) funded projects is 0.0%. It is anticipated that FM funded projects will not exceed the threshold of $250,000. FM funds are passed through to sub-recipients who set DBE goals as appropriate. The proposed DBE goals will become effective October 1, 2008 and will continue until December 31, 2009. The DBE goals will be recalculated annually. Public Notice of Certification of Annexation Petition Pursuant to Utah State Code Ann. 10-2-406 Coalville City hereby gives notice as follows: 1. A petition for Annexation has been received in the office of the Coalville City Recorder for the purpose of requesting the annexation of the following parcel of land. Said compete petition was received on September 11, 2007. The Coalville City Council heard the petition at their regularly scheduled meeting on September 8, 2008 and acted to accept the petition for consideration; 2. On September 9, 2008 the Coalville City Council received the required Notice of Certification for the City Recorder certifying that the petition satisfies the requirements of state law. 3. The area proposed for annexation is located west of the current municipal boundary, more specifically described as follows: FDA Finds Hazardous Levels of Selenium in Samples of “Total Body Formula” and “Total Body Mega Formula” Dietary supplement products linked to adverse reactions The U.S. Food and Drug Administration announced today that it has found hazardous levels of selenium in samples of certain flavors of the dietary supplement products “Total Body Formula” and “Total Body Mega Formula.” The FDA has received 43 reports of persons from nine states who experienced serious adverse reactions using these products. On March 27, the FDA warned consumers not to purchase or use “Total Body Formula” in flavors Tropical Orange and Peach Nectar and “Total Body Mega Formula” in the Orange/Tangerine flavor of these products after receiving reports of adverse reactions in users in Florida and Tennessee (www.fda.gov/bbs/topics/NEWS /2008/NEW01812.html). The adverse reactions generally occurred after five to 10 days of daily ingestion of the product, and included significant hair loss, muscle cramps, diarrhea, joint pain, deformed fingernails, and fatigue. Selenium, a naturally occurring mineral, is needed only in very small amounts for good health. Selenium can boost the immune sys- tem. Generally, normal consumption of food and water provides adequate selenium to support good health. Excessive intake of selenium is known to cause symptoms to include significant hair loss, muscle cramps, diarrhea, joint pain, fatigue, loss of finger nails and blistering skin. Presently, FDA has 43 reports of adverse reactions including cases from Alabama, Florida, Georgia, Kentucky, Michigan, New Jersey, North Carolina, Tennessee, and Texas. Analyses of samples of the products by FDA laboratories have now found most of the samples contain extremely high levels of selenium—up to 40,800 micrograms per recommended serving, or more than 200 times the amount of selenium per serving (i.e., 200 micrograms) indicated on the labels of the products. The FDA continues to investigate the matter to determine how excessive amounts of selenium were added to the products. FDA is advising consumers to stop using “Total Body Formula” in flavors Tropical Orange and Peach Nectar and “Total Body Mega Formula” in the Orange/Tangerine flavor and discard them by placing them in a trash receptacle outside of the home. “Total Body Formula” products are sold in eight-ounce and 32-ounce plastic bottles. “Total Body Mega Formula” is sold in 32-ounce plastic bottles. Both product lines are distributed by Total Body Essential Nutrition of Atlanta, which is listed on the products’ labels. Consumers who have been taking the products and have experienced adverse reactions should consult their health care professional. Consumers and health care professionals are encouraged to report adverse events to the FDA’s MedWatch program at 800-FDA-1088 or online at www.fda.gov/medwatch/how.ht m. The sole distributor of the “Total Body Formula” and “Total Body Mega Formula” products has voluntarily recalled the affected products. According to the company, the products were distributed nationwide. UPAXLP Obituary Eugene Robert “Sonny” Kidd Eugene “Sonny” Kidd, 80, passed away Saturday, Sept. 20, 2008, at McKay-Dee Hospital. He was born July 28, 1928 in Coalville (Summit County), the son of John Gentry and Nettye Ackerman Kidd. One sister, Retha Joy Fair (deceased), and was raised by his beloved “Auntie” Myrtle Scruggs upon the death of his parents by the age of 12. He Graduated from North Summit High School in 1946, and recently attended the class reunion. He was so happy that his health was good enough that he could attend this event. Married Dona Matue on April 14, 1948, in Henefer. Later married in the Ogden Temple April 14, 1977. They celebrated 60 years of marriage this year; survived by his wife, and two children, Annette (David) Degiorgio and Ryan (Helen) Kidd; four grandchildren, Lisa, Chad, Taryn and Breanne; eight great-grandchildren all of whom he loved deeply and supported in all they did. Had an unparalleled work ethic and at times worked two jobs to provide for his family. Worked as a telegrapher for OUR & D Railroad and the U.S. Postal Service as a mail carrier in Sunset. After his retirement he began working at The Old Farm Market as the general fix-it man where he could be identified by his overalls, his “Grampa” nametag, and his whistling. He loved baseball and played catcher on local teams. Also coached a girl’s softball team from Henefer, the “Shmoos”. He loved his girls and always had a gift for each of them at their annual Christmas party. He enjoyed bowling and was president of several bowling leagues in the area. Served in three bishoprics, elected to the Sunset City Council, active in Sunset Jaycees, served on the Davis County Senior Citizens board. He loved decorating his home at Christmas and won an award from the city for his display. Loved flowers and worked hard in his yard. He loved people and made friends wherever he went. Special thanks to Crestwood Care Center for their loving care of Eugene. In lieu of flowers, donations may be made to Applegate Hospice. Funeral services were held Thursday, Sept. 25, at the Sunset 4th Ward, 220 West 975 North. Interment was in the Henefer Cemetery. |
