The subpoena, issued a week before Gonzales is to testify under oath before Congress about the dismissals, seeks hundreds of documents either withheld or heavily blacked out by his department. The subpoena sets a Monday deadline for Gonzales to produce the documents. "We have been patient in allowing the department to work through its concerns regarding the sensitive nature of some of these materials," House Judiciary Committee Chairman John Conyers, D-Mich., wrote Gonzales in a letter accompanying the subpoena. "Unfortunately, the department has not indicated any meaningful willingness to find a way to meet our legitimate needs." Investors await word on gains as stocks increase NEW YORK (AP) - Stocks edged higher Tuesday as investors refrained from major moves ahead of first-quarter earnings reports that began with Alcoa Inc/s results after the closing bell. A modest increase in the Dow Jones industrials marked the eighth-straight win for the blue chip index, its longest such streak since 2003. Aluminum producer Alcoa reported a better-than-expected first-quarter profit, pleasing investors who bid the company's stock up in after-hours trading. Wall Street was looking for results from the Dow component to not only gauge the pace of earnings for the quarter but as a proxy for the health of the overall economy. TYiesday was the second day in a row that stocks showed little overall movement as investors awaited news of how companies fared during the first quarter, and also their expectations for the coming quarters. In the fourth quarter, Standard & Poor's 500 companies snapped an 18quarter streak of double-digit profit gains, and Wall Street expects profit growth to remain in the single digits for the first three months of the year. JACKSBORO, Tenn. (AP) - A 15-year-old boy pleaded guilty Tuesday in the killing of a high school official and the wounding of two others under a plea deal announced after jury selection for his trial had started. The judge sentenced Kenneth Bartley Jr. to 45 years in prison for the single count of second-degree murder and two counts of attempted second-degree murder in the 2005 shootings at Campbell County Comprehensive High School. Before the plea, Bartley met privately to apologize to the victims, Assistant Principal Jim Pierce and Principal Gary Seale. "He said he wished he hadn't done it and that he wished he could take it back," said Pierce. "We will never be the same, but we told him that we forgave him." The teenager could have faced a life sentence if convicted on the original charges. He will be held in a juvenile facility until he is 19, then move to adult prison. Bartley could be eligible for parole in 25 to 29 years. His plea deal was announced after special Judge Jon Kerry Blackwood consulted with defense and prosecution attorneys, the two surviving administrators and the widow of the man who died. The three school officials had confronted Bartley on Nov. 8, 2005, after hearing that he had a gun in the school. Bartley was in the principal's office when he fatally shot Assistant Principal Ken Bruce, 48, and wounded Seale and Pierce. The defense conceded during the questioning of potential jurors that Bartley, then 14, shot all three men. The boy had been in and out of trouble while in middle school and had spent about a year and a half in a residential juvenile treatment program. Deputy Sheriff Darrell Mongar testified during a February hearing that Bartley told him the pistol was his father's and he planned to trade it for OxyContin, a powerful painkiller. j Pierce testified at that hearing that he told Bartley he wanted the gun the boy had in his pocket. "Kenny stood up with the gun waving it at all of us," Pierce said. "Mr. Seale asked him if it was real. He said 'Yes, it's real. 1*11 show you. I never liked you anyway.'" Pierce said Bartley pulled out an ammunition clip, loaded the gun and fired. Seale was shot first, in the lower abdomen. Bruce was shot in the chest. Pierce was hit in the chest as he struggled to disarm the youth, he testified. Bartley had been indicted on charges of firstdegree murder and felony murder, both of which could have carried a life sentence — meaning a minimum of 51 years in prison. He also was charged with attempted murder, taking a gun to school grounds and possession of controlled substances, which could have added to his sentence if he were convicted. Jury selection was wrapping up when the agreement was reached. Jo Bruce, the widow of the slain administrator, endorsed the plea bargain. "We did the right thing. We feel like this will help our community start to heal. I think (my husband) Ken would say, 'Job well done/" Bruce said. NASSAU, Bahamas (AP) - DNA tests prove it: Larry Birkhead is the father of Anna Nicole Smith's million-dollar baby. "I told you so!" | the late Playboy Playmate's former boyfriend said Tuesday upon emerging from a closed court hearing. He added: "My BlRKHEAO baby's going to be coming home pretty soon." Birkhead, a 34-year-old California photographer, then hugged his rival, Howard K. Stern, who has been caring for baby Dannielynn since Smith's sudden death in February. The hearing was a pivotal moment in the battle over who gets custody of the girl, who could inherit a fortune from the estate of Smith's late husband, J. Howard Marshall II. Although Birkhead is the father. Sterns name is on the birth certificate. Another custody hearing was scheduled for Friday. Stern, who was Smith's lawyer and later became her companion, said he wouldn't fight for custody, but a lawyer for Smith's mother, Virgie Arthur, indicated she might. The judge scheduled another hearing for Friday in the pink colonial courthouse to discuss who will raise the girl, who could inherit hundreds of millions of dollars. Stern said he loved the baby despite the DNA results and would support Birkhead. T m obviously very disappointed, but my feelings for Dannielynn have not changed," he said, adding of Birkhead: "I'm going to do whatever 1 can to make sure he Late Night David Letterman, April 9, 2007 Top Ten Things I Can Say Now That I've Won The Masters Suspected terrorists blow themselves up after police surround their hideout 10. CASABLANCA, Morocco (AP) - Police surrounded a building in Morocco's largest city where four terrorism suspects were holed up Tuesday, forcing three of the men to flee and blow themselves up with explosives. The fourth was shot by police as he was apparently preparing to detonate his bomb. A police officer was killed in the operation and a young child was injured, officials said. The explosions in Casablanca, weeks after the bombing of an Internet cafe in the city, promised to further rattle the North African kingdom whose first high-profile brush with Islamic terrorism came in five suicide bombings in the city in May 2003. Moroccan authorities responded to those attacks, which left 45 people dead, with the arrest of thousands of alleged Islamic militants — some accused of working 8. The suspects were all allegedly connected to the March 11 bombing of the Internet cafe — an attack that killed the bomber, Abdelfettah Raydi, and four others. Tuesday's violence started when police, acting on a tip, surrounded a four-story apartment building in the workingclass Hay Farah neighborhood of Casablanca where the suspected terrorists were holed up, officials said. One of the suspects fled to the roof, where he blew himself up, said a police official on the scene who refused to give his name, saying he was not authorized to do so. Morocco's official MAP news agency identified that bomber as Mohamed Rachidi. Premier Student Apartments 677 East 600 North AP Photo/Wade Payne KENNETH BARTLEY AWAITS SENTENCING in Jacksboro, Tenn.
