Show amendments TO section 3 article XIII of the conati gutlon as amended november 6 1900 and section 12 of said article XIII relating to uniform tax and exema alons and authority ot the legislature to provide tor a stamp tax or a tax based on income occupation licenses or franchises be it resolved and enacted by the legislature of the state of utah two thirds of all members thereof concur tine therein section 1 the following proposition to amend the constitution of the state of utah Is hereby submitted to the qualified electors of the state for their approval or disapproval namely that section 3 article XIII of the constitution of the state of utah amended november 6 1900 and sec alon 12 ot said article XIII be and the same are hereby amended to read as follows section 3 the legislature shall provide by law a uniform and equal rate of assessment and taxation on all property in the state according to its value in money and shall prescribe by general law such regulations as hall secure a just valuation for tax atlon of all property so that every person and corporation shall pay a tax in proportion to the value of his her or its property provided that a de auction of debits from credits may be authorized provided further that the property of the united states of the state counties cities towns school districts municipal corporations and public libraries lots with the buildings thereon used exclusively tor either re worship or cl arl table pur poses and places of burial not held or used tor private or corporate benefit shall be exempt from taxation ditches canals reservoirs pipes and flumes owned and used by individuals or corporations tor irrigating lands owned by such individuals or corpora alons or the individual members there of shall not be separately taxed as long as they shall be owned and used exclusively tor such purpose provided further that mortgages upon both real and personal property shall be exempt from taxation provided further that the taxes of the indigent poor may be remitted or abated at such time and in tuch manner as may be provided by law 12 stamp income license fran calse or mortgage tax permissible nothing in this shall be construed to prevent the legislature from providing a stamp tax or a tax based on income occupation licenses or franchises section 2 the secretary of state Is hereby ordered to cause these apropo editions to be published in at least one newspaper in every county of the state where a newspaper Is published for two months immediately preceding the next general election section 3 tl ese propositions shall be submitted to the electors of this state at the next beneral election for their approval or disapproval all of fickal ballots used at such election shall have printed or written thereon the words for the amendments to sec tion 3 article XIII of the uns titu alon as amended november 6 1900 and against the amendment to sec alon 3 article XIII of the Cons titu alon as amended november 6 1900 also the words for the amendment to section 12 article XIII of the conati gutlon and against tha amendment to section 12 article XIII of the con together with such other title designating such amendment as may be provided by law said ballots shall be received and said votes shall be taken anted canvassed ird rev turns thereof be made in the same thinner and in all respects as Is pro vided bv law in the case of the elec lion of the state officers bention 4 these amendments it adopted at said election shall take ef feet and be in force from and after the first day of january A D 1907 state of utah office of the secretary of state I 1 charles S Secie tary of state of the state of utah do hereby certify that the foregoing Is a full true and correct copy of a resolution proposing amendments to section 3 article XIII of the constitution of the state of utah as amended novem her 6 1900 and section 12 of said ar tide XIII relating to uniform tax and exemptions and author ity of the legislature to provide tor a stamp tax or a tax based on income occupation licenses or franchises passed at the sixth regular session of the legislature of this state in testimony whereof I 1 have here unto beet my hand and affeld the great seal of the state of utah at salt lake city day of august A D 1906 seal secretary of state |
