Hardy was so inforiated with the hospitals decision to end his contract that he verbally attacked Allred in a hospital hallway, according to court records. Allred filed suit against Hardy ft defaming his reputation and eventually filed a protective order against Hardy . Three years after it waa filed, Hardys case against the Uintah Basin Medical Center was dismissed by 8 District Court Judge John Anderson without a hearing. Hardy appealed to the Utah Supreme Court, which remanded the case hack to district court for Author review of foll-tim- Medicine. Hardy, who lives in Price, was hired in 1994 to work at the hospital one day a week, or eight hours a month. According to court records, he ran a circuit of pathology services throughout nuid Utah, and depended on his contract with tha UBMC to make his route economically feasible. He also maintained his work at the hospital was exemplary and was not a reason for termination. His contract with the hospital included a clause which allowed either party to terminate the agreement with a y notice for just cause. But Hardy maintains hospital officials acted unreasonably and violated their end of the deal when they released him to hire Allred. Court records state the hospitals board oftrustees "wanted to move in a different direction by providing patients with the services of a felltime pathologist and decided it was in the best interest of the hospital to end Hardy contract. In court reports, hospital officials said they felt they "acted in a manner which waa fair and honest, and offered a good cause to terminate.
