How do you answer such a question? First of all. Im never ready for the holiday. The holidays juat roll forward and I seem to drag behind in their wake ... I eat cookies, get fat, and applaud the entire spectacle of the season. The lights, the carols, the warm fuzziea of it Moat of the time readiness eludes me and Im wrapping gifts in decorative paper towels and duct tape on the front eeat of the car as we head out for a party. Its not that I dont try. Early this year 1 started buying little gifts here and there, but that didnt work out too well because now I have no idea who I bought the velvet painting of Elvis for. Ive even studied up on holiday preparedness. Ive prepared cookie dough ahead, frozen it, and allowed it to thaw while Im electrocuting myself with strings of Christmas lights. Have you ever noticed how pine pitch all over your hands makes a perfect conductor? After the tree waa decorated I smugly tied an apron around my waist and unwrapped the cookie dough to slice and bake only to find it was last summers trophy trout. Now I ask you, why doesnt preparedness work like the author says it will? People who know me can catch me fibbing in the blink of an eye. But sometimes when I hear, So, are you ready for Christmas?" I cant help but answer, Oh, of course. d Any person is by October 15, but, I usually answer in truth, saying, No, but then its not midnight on Christmas Eve yet, is it? re re By Lorna Stradinger Duchesne County Commissioncontracted with attorney L. Because Ruiz ia indigent the law provides that he ia entitled to a court appointed attorney whose fees are paid for by Duchesne County. All trial expenses incurred by Ruiz are also the responsibility of the county. Public defenders in capital cast i must qualify under Utah State Stat ute, Rule 8. Rule 8 includes various requirements to ensure the defendant receives an adequate defense. One requirement is that at least two attorneys try the case. Another states that at least one attorney must have previously tried a capital case from the beginning to the end. Rule 8 also mandate that the defending attorneys for capital murder cases receive education beyond a law degree. The requirements of Rule 8 result in the skyrocketing of attorneys fees, said Pullman, as well as narrowing the pool of qualified legal professionals who are allowed to specialize in capital cases. The Utah Highway Patrol and Operation CARE offers the following suggestions to help fight impaired driving: Be a responsible host. Serve food and have drinks available. Dont let your guests drive after drinking alcoholic beverages and never serve alcoholic beverages to someone under the age of 21. Never ride in a car with someone who has been drinking or using drugs. Call a cab or ask a friend to drive you home. Contact elected government officials and express your concern over drunk and drugged driving and underage drinking in the community and encourage them to support laws that effectively address these serious social problems. Immediately report those who appear to be driving while impaired to a law enforcement agency by calling 9 1 1 on a cell phone or pay phone . Be aura to note the license plate number, description of the vehicle, the highway they are on, and the direction of travel. Keep a safe distance from anyone driving erratically and do not try to intervene yourself. Remember, you can encounter a drunk or drugged driver at any time. The bids were close, ranging from $65,000 to $75,000. Pullman recommended the Commission select Dean Zabriaki, who bid the job,at $75,000. "Zabriskie has the advantage of providing continuity because he has been involved with the trial from the beginning. Zabriaki waa retained by Ruiz earlier in the case to represent him on the second degree burglary charge. Ruiz speaks primarily Spanish and would require an interpreter. Zabriskie is a former certified translator in the Spanish language, a critical fact that would save the county considerable money in interpreters fees, suggested Pullman. Zabriskie has practiced law since 1971 and cites between 75 and 100 cases of mqjor trial experience since 1992. Donaldson has been a sole practitioner since 1993. He earned his law degree from the University of Oregon Law School. Donaldsons resume cited 23 felony and capital cases since 1990. Duchesne County is unlucky that the murder occurred within the county, says Pullman. "It ia a sad, sad truth that capital cases cost a county a lot of money. An additional seven charges were filed against Ruiz since commissioners made the decision to hire Donaldson, which may increase the bid before the contract ia drawn. Mike Winn, ChiefofSpecial Prosecution Attomqy General for the State of Utah, will assist county attorney Herb Gillespie in prosecuting the case. 'poor c |
