that he didn'L Two weeks ago a friend of mine from last year called me outside to take a look at the outside wall of Sessions Hall He pointed to the side of the wall and began to laugh Strewn across the wall were various colors of Play dough balls that JD and a couple of his friends myself included had thrown up there last year Memories filled my hod as I recalled who had thrown which balls Shane's JJVsand mine were remaining I began to laugh as the symbolism dawned on me Even after death JJVs balls are still up on the wall and now with the acceptance of this assignment mine will become a fixture there as well Ibis column is not going to be an attempt to duplicate Joscoh (continued on page 6) Supreme Court says no tax exemption for missionary funding Tax Notet a leading journal for tax practitioners in the United States recently published an article written by Ron Vogel an accounting instructor al the College of Eastern Utah and Weber State College professors Rick Grosser and Doug Laufer The article analyzes the impact of a recent US Supreme Court decision that parents of Mormon missionaries cannot deduct payments made directly to their children serving missions as charitable contributions The Court's decision actu- ally clarifies which contributions are deductible and which are not" Vogel explained There was no consistency prior to the decision and the IRS had an extremely difficult time determining which payments were legitimate deductions and which weren’t" According to the analysis direct support of Mormon missionaries by their parents was established more than 160 years aga Several court cases however examined the legality of deducting those payments Previous court rulings stated that although the church benefited from the contributions the recipients not the church had full control over the funds which was contradictory to laws governing charitable donations Under this system the missionaries "apparently had no legal obligation to comply with their promise to use the money in accordance with chinch guidelines" the analysis reports The Fifth and Tenth Circuit courts had ruled that the church's control over missionaries also controlled the use of the funds but the Ninth Circuit Court rejected the argument and disallowed the deductions because the contributions were not made directly to the church "The Supreme Court saw the potential for loo many abuses of the law if deductabUity were allowed for existing practices" Vo gel said "Although the ruling will have significant impact for the LDS Church the decision actually clarifies and strengthens current tax laws" Legislation is currently being considered that would allow such payments to be classified as a charitable deduction overturning the High Court's opinion Vogel participated in the research and composition of the analysis while a graduate student at Weber State He has taught accounting and other business courses at the College of Eastern Utah since 1989 |
