Show Ordinance No. 32 AN ORDINANCE ING FOR THE CONTROL PROVIDREGULA-TOO- COLLEC- TION AND DISPOSAL OF GARBAGE; PROVIDING FOR ESTABLISMENT AND ENFORCEMENT OF NECESSARY AND PROPER REGULATIONS FOR STORAGE, COLLECTION AND DISPOSAL OF GARBAGE AND WASTE MATTER; PROVID-INFOR THE LEVYING OF SERVICE CHARGES WHICH SHALL BE ASSESSED AGAINST ALL PERSONS HAVING GARBAGE TO BE REMOVED; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF ROOSE-VELCITY: SECTION 1. There la created hereby a Waste Removal Department of the City of G the Roosevelt Cily Council and such other charges as may be established by classification of rotes based on the type and needs for gnrbnge and waste matter collection all to be established by resolution of the Roosevelt City Council. It shall be unlawful for any owner or his agent or other pci son hnving charge of or occupying any property located within Roosevelt City to remove or dispose of any garbage or waste matter as defined in this ordinance other than in accordance with the rules and regulations to be established by resolution of the Roosevelt City Council and said person must make said garbage and waste matter available for collection and disposal in accordance with the rules and regulations established by resolution of the Roosevelt City Council. SECTION 10: All garbage and waste matter receptacles shall be kept in a clean and sanitary condition by the owner or person using the same, and garbage receptacles shall he kept tightly covered at all times except when garbage is being deposited therein or removed therefrom, and shall at all times be proof against the access by flies to the contents thereof. SECTION 11: All garbage shall be placed in the garbage receptacle required by Section 9 of this ordinance. All waste matter must be placed in the receptacle, or depositories provided for said waste matter, or in the garbage receptacle. SECTION 12: No liquid garbage shnll be deposited with any garbage or waste matter. All kitchen garbage shall be drained of any moistuie and completely wrapped in paper before being placed in the garbage container. Bulky waste matter such as trimmings from lawns and gardens, weeds and cardboard boxes must be bundled so as not to exceed three feet in length nor thiity pounds In weight. SECTION 13: It is unlawful for any person engaged in hauling gnrbage or waste matter of any kind upon the streets of Roosevelt City to permit, suffer, allow or cause any of said matter to fall into or to remain in said streets SECTION 14: It Is unlawful for any person to convey, transport or haul upon the streets of Roosevelt City any garbage or waste matter un- leas the same Is contained In a sanitary receptacle especially constructed for that purpose and tightly covered and In good condition and adequate to prevent spillage or escape of noxious odors. SECTION 15: It is unlawful for any person to suffer, permit or allow any vehicle controlled by him and which is loaded with garbage or other waste materials specified herein to be or temaln standing on any public street within Roosevelt City any longer than may be necessary for the purpose of loading the same or moving the same to Its destination in accordance 'with applicable traffic laws and regulations. SECTION 16: The proper person appointed by the City Council shall visit all premises within the coiporate limits of the City of Roosevelt from time to time to examine the sanitary conditions of said premises to determine whether the provisions of this ordinance are being compiled with. Upon notification by proper person, or his representative, ail poisons, firms or corporations, shall within three days after notice, comply with the provisions of this ordinance or be deemed guilty of a misdemeanor. SECTION 17: Removal of garbage or waste matter from the premises shall be made at least once a week from private residences and as many times per week as the City Council may order from all meat, fish, game, and vegetable markets, restaurants, boarding houses, hotels, hospitals, retail stores, wholesale stores, manufacturing establishments, and other like places. SECTION 18: The Roosevelt Council, by resolution, hall classify and determine which class the gaibage collection service furnished any owner, renter, agent or occupant or any building or portion of apartment thereof, or any structure of whatevci type or nature or any premises shall fall or come within. Said Roosevelt City Council shall be the sole judge of what unit or classification the garbage collection service ronics within and which Is given to the said owner, renter, agent or occupant And from time to time, the said Roosevelt City Council shall cause a remirvey of said classifications and shall make whatever changes or adjustments or classifications as may be necessary to carry out the Intent and purpoae of this ordinance: aubjrct, however, to the right that any person may in writing requeat the Roosevelt City Council to reto view the classification which inch person belongs. Upon auch lequest the Roosevelt City from the occupant of said pioperty, but nothing in this section shall relieve said occupant from prosecution for a misdemeanor for any violation of this ordinance. SECTION 19: The owner or his agent, or the occupant, of any premises within the City of Roosevelt, Utah, shall be responsible for the sanitary condition of the premises occupied by him, and it shall be unlawful for any person to place, deposit, or allow to be placed or deposited on his premises any waste matter, except as designated by the terms of this ordinance. It shall be unlawful to place or deposit waste matter on another person's premises. SECTION 20: Inspection The person appointed by the City Council, after identifying himself, shall have the power to enter at reasonable times upon private or public property for the purpose of inspecting and investigating conditions relating to the enforcement of the provisions of this ordinance. SECTION 21: The Roosevelt City Council shall place said charge on the quarterly culinary water statement and upon collection of the same, it shall be placed In the City Treasury in a separate fund to be known as the Waste Removal Fund" and disbursed by Roosevelt City Council. SECTION 22: The Roosevelt City Council, shall have the power to establish rules and regulations consistent with the provisions of this ordinance, governing the keeping, collection, removal and disposal of garbage and waste matter. SECTION 23: If any person adopted by the Roosevelt City Council on the 21st day of September 1970, Bnd published on the 1st day of October, 1970, as the sumc upxars in my office. SECTION 24: This ordinance, immediately upon its passage, shall be approved and authenticated by the City Mayor, attested by the City Recorder under the corporate seal of the City, and the same shall be published in one issue of the Uintnh Basin Standard, a newspaper published within Roosevelt City, and shall be recorded in the Ordinance Book of Roosevelt City, together with the proof of publication thereof. SECTION 25: That all ordinances or parts of ordinances, in conflict with this ordinance are hereby repealed. SECTION 28: That in the opinion of the City Council of Roosevelt City, an emcigency exists, and that It is necessary on account of such emergency, and in the interest of the conservation of peace, health and safety of Rooseclt City, and its Inhabitants that this Ordinance No. 32 shall take effect on Its passage and publication.
