WHEREAS; the City of Roosevelt desires to defray the costs of expanding and improving the water system in said City through the issuance of $150,000 General Obligation Water Bonds; and WHEREAS, it is desired to submit a proposition concerning the issuance of such bonds to the vote of the qualified electors of said City pursuant to the provisions of the Utah Municipal Rond Act; NOW THEREFORE, Be It Resolved by the City Council of Duchesne Roosevelt, County, Utah, as follows: Section 1. On the 2nd day of December, 1975, there shall be held in Roosevelt a special bond election between the hours of 7 o'clock a.m. and 8 o'clock p.m., at which time there shall be submitted to the qualified electors of said City the proposition in the form of ballot set out in Section 4 hereof. Section 2. The voting place for the election and the officials who are hereby appointed to serve at such voting place shall be those specified in the form of Notice of Election set out in Section 3 hereof. Said officials are qualified electors of said City. Section 3. Notice of the election shall be published three (3) times, once a week for three (3) consecutive weeks, the first publication to be not less than twenty-on- e (21) nor more than thirty-fiv- e (35) days before the election in the Uintah Basin Standard, a newspaper of general circulation lit RdoseVelt, Utah,2 and qualified to carry legal notices under the laws of the State of Utah. The notice shall be in substantially the following form: ELECTION NOTICE To all qualified electors of Roosevelt, Duchesne County, Utah: Take notice that on the 2nd day of December, 1975, an election will be held in the City of Roosevelt, Duchesne County, Utah, at the places set out below for the purpose of submitting to the qualified electors of said City the following proposition: PROPOSITION Shall the City Cojmdl of Roosevelt, Utah, be authorized to issue the General said City in the amount of not to exceed One Hundred Fifty Thousand Dollars (150,000), bearing interest at a rate or rates not to exceed one per cent per annum, and due and payable in not to exceed twenty (20) years from the date of said bonds; these bonds to be issued and sold for the purpose of defraying all or a part of the cost of expanding and improving the water system of the City? Said election will be held at the following polling places and the persons indicated as follows will act as election available at each polling place a registration list or a copy thereof listing all registered electors entitled to use such voting place. Notice is further given that on Tuesday, the 2nd day of December, 1975, that being within ten days after said election, the City Council will meet at its regular meeting place in Roosevelt City, Utah, at 8:30 o'clock p.m., and canvass the returns and declare the results of said election. Defendants COME NOW the plaintiffs above named and hereby allege as follows: 1. The said plaintiffs are all residents of the State of Washington, and the said and plaintiffs individually jointly claim an estate in the property located in Duchesne County, State of Utah, and more particularly described as the North Half of Section 8, Towpslpp .5 ,J5puth, Range 4 West; Uintah.: Special Meridian, Utah, containing 320 acres, more or less. 2. Defendants, individually and jointly, claim an estate or interest in said land adverse to the plaintiffs, and the claim of the defendants and each of them is without any right whatsoever; defendants have no, nor have any of them, any estate, right, title or interest whatever in said land or premises. 3. The claims of the defendants set forth above are those which have been derived through the chain of title and located in Duchesne County, State of Utah. 4. The records indicate and show that a patent to the above described property was given to James Hand and Edward Hand, pursuant to that patent recorded on August 12, 1952 at 10:30 o'clock A.M. in Book 6 of patents at page 387 in the Recorder's Office of Duchesne County, State of Utah. 5. It is alleged that Edward Hand, one of those who received the property above described, died in approximately 1930, and that he conveyed to his sister, Kate O'Neill, his interest in the said property. ' day '" a quit claim deed wherein she ronveyed to Janies Edward hand, one of Ihe plaintiffs named above as the heir of James Hand, the property described as the North half of 15, Section 8, Township Range 4 West, Uintah Special Meridian, and the same was recorded on June 21, 1949 in Book 23 of Deeds at pages 332 and 333. This conveyance ronveyed any purportedly interest that the said Kate O'Neill had in the said property to James Edward Hand. 6. The records further show that the defendants. Alice Haber man and Jane O'Neill are the executrices of the estate of Kate O'Neill, deceased, and a quit claim deed was given from them in that capacity to correct the legal description of the quit claim deed given by Kate O'Neill in 1949 as set forth above, and the quit claim deed purports to convey this land to James Edward Hand and is property described as set forth above as the North half of Section 8. Township 5 South, Range 4 West, Uintah Special Meridian. 7. That the said James E. Hand, aka James Edward Hand, died on or about February 13, 1975 and that the said James E. Hand was married to Dorothy Hand, one of the defendants named above, who passed away on 1973. 8. The defendants February 14, John Doe and Jane Doe are placed in the complaint for the purpose of including any other person who may claim any interest in said property. 9. That the said plaintiffs above named, Catherine Hand Greene, James Edward Hand and Patrick Joseph Hand, are the heirs and the sole heirs, of James E. Hand, who passed away on February 13, 1975 and art entitled .to have the title to the said property conveyed to them pursuant to Court Order as the sole and only heirs of the deceased parties and others as set forth above. WHEREFORE, plaintiffs pray judgement as follows: 1.
