Kershner Stare Decisis One of the things a lawyer must do in preparing a case is to look up precedents of cases analogous to the one before him. The common law and later, the written law, was built up on the basis of many decisions that had been made in previous years wherein wise men undertook to establish the truth as between right and wrong and to decide a particular case accordingly. One who gives proper weight to these decisions antedating the one he himself must make acquires great respect for the wisdom of his forebears. He hesitates to set up his own judgment in contradiction to that of serious minded men who have preceded him. Hence changes are made slowly and with caution. The principle of law we are herein describing is called stare decisis and it means respect for the past high regard for the decisions other men have made in years gone by. Why should one of this generation assume his wisdom is superior to that of his fathers? This is why the founder of our country urged in his thanks. He is concerned with personal survival in the legal jungle. No mouse in his right mind argues with the hyena. One might argue that it is unfair to lawyers to compare them to mice. In other words, two centuries of decisions by this Court are sometimes swept aside as the present Court modifies the Constitution, Bill of Rights and laws in its own image. To take one example, the first Article of the Bill of Rights: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof . . . At the very time the Bill of Rights was written, established religions existed in several of our states. The first Article of the Bill of Rights did not refer to what the states might or might not do, it simply prohibited Congress from making laws respecting an establishment of religion.
