Roth Jr. has introduced a bill to create a special division of the IRS to hear the grievances of taxpayers. The bill would require an Ombudsman to report directly to Congress. But the Roth bill would go further than that. It would require the IRS to give taxpayers a written statement of its reasons for conducting an audit, to advise them of their constitutional rights, and to eliminate much of the secrecy surrounding audit procedures. Currently, the agency advises taxpayers of their rights only in criminal matters. It gives no such advice in civil cases. For instance, it doesnt even tell the tax victim that hes entitled to a lawyer when agents come to audit him. And it doesn't warn him that he may need legal advice before he signs the confusing forms and consents presented to him by IRS agents! The Roth bill look's interesting. If a rapist is entitled to be told he has the right to a lawyer, then an honest citizen in a civil tax dispute should certainly be given a similar courtesy.
