Recorder together with a certified copy of this ordinance Section 2 Recordation of Annexation Plat and Ordinance The City Attorney is to provide for recordation hereby instructed of a certified copy of this ordinance and the annexation plat attached hereto as Exhibit "A" in the office of the Millard County Utah Recorder after completion of the pursuant following: a Fulfillment of all the conditions and quirements set out in this ordinance and b Determination by the City Attorney that all legal requirements have been met for annexation of the subject territory into Delta City 3 Effect of Annexation on AnSection nexation Territory Upon recordation of the annexation plat provided for in Section above the annexed territory shall be extended all rights and privileges of the City of Delta Also the territory annexed shall then be subject to and required to comply with all ordinances restrictions and regulations of the City of Delta Those owners of real property within the annexed territory and the improvements and personal property located thereon that are subject to ad valorem taxes shall further be required to pay such addition taxes and assessments as may be levied by the City of Delta upon compliance by the City of Delta with the quirements of Chapter 12 of Title II Utah Code Annotated (1953) as amended The residents of the area shall further be entitled to connect to the Delta City municipal water and sewer system upon compliance vith the present requirements of the City as amended by this ordinance At the time this annexation becomes effective residents of the annexation area will be entitled to police and fire protection and other services rendered by the City of Delta and to the protections offered by Delta City ordinances and other benefits generally enjoyed by the of the City of Delta by present residents tue of their residence within the corporate boundaries of Delta City Section 4 Amendment to Master Annexation Policy Declaration The provisions of this ordinance shall be deemed to be an amendment to the Master Annexation of Delta City as it relates Policy Declaration to the territory described in Exhibit "A" To the- extent that any portion of the Policy Declaration Statement for Annexation as amended by Resolution establishing the Delta City Master Annexation Policy Declaration conflict with the provisions of this ordinance this ordinance shall be deemed controlling but only as to the annexation territory described in Exhibit "A" hereto Section 5 Statement of Compliance with Statutory Annexation Criteria The annexation provided for herein complies with the statutory requirements set out in Part 4 Chapter 2 Title 10 Utah Code Annotated as amended in that: (1953) a The annexed territory is contiguous to the boundaries of the present corporate limits of the City of Delta b The annexed territory lies within the area projected for municipal expansion under the Delta City Policy Declaration Statement for Annexation as amended within the c The territory is not included boundaries of another incorporated municipality d This annexation will not create unincorporated islands within the boundaries of to which the City of Delta Utah will or will not favor annexation of territory into the corporate limited of Delta City B On November 25 1985 the City Coun- giving adopted Resolution No preliminary approval to the petitions for nexation for the Sugar Factory Row annexation and adopting proposed amendments to the Delta City Master Policy Declaration Statement related to that annexation C The Delta City Planning and Zoning Commission has recommended annexation of the property described in the annexation plat attached hereto as Exhibit "A" designated as the "Sugar Factory Row Annexation" and has determined that nexation of such property will be consistent with the criteria set out in the Delta City Master Annexation Policy Declaration provided that certain terms and conditions relating to the annexation territory or parts thereof are met The Planning and Zoning Commission has further recommended that certain amendments be made to the Delta annexation policy as part of said City annexation D A public hearing was held pursuant to proper notice by the Delta City Council on December 17 1985 for the purpose of receiving public comments on the amendments were set out in the proposed policy declaration amendments adopted on November 25 1985 In that hearing public comment and information was received and considered Comments were subsequently considered by the Delta City Council as they relate to the present annexation No protests to the annexation were filed within five (5) days from the date of the hearing by any fected entity as the term is defined by Utah statute E The City Council has determined that a need exists to annex the territory described in the subject annexation petitions to provide for improvement of existing water facilities owned by Delta City and delivery of related services and to provide for extension of municipal sewer services and other necessary municipal services to meet the needs of the residents of the annexation territory and to promote equitable distribution of the burdens of providing municipal cil services F The City Council has determined that the annexation territory should be zoned in accordance vith the Delta City Master Plan and the annexation policies such that the historical land uses within the annexed territory can be continued The City Council has therefore determined that the territory should within be included the and 8 AN ANNEXED TERRITORY AND GIVING FINAL ACCEPTANCE TO THE ANNEXATION PETITION SUBMITTED BY VARIOUS PROPERTY OWNERS WITH RESPECT TO THE ANNEXATION IDENTIFIED AS THE “SUGAR FACTORY ROW ANNEXATION” The City Council of the City of Delta Utah referred to herein as the "City Council" recites the following as the basis for adopting the ordinance set out hereunder: A Previous to the submission of the nexation petitions described herein Delta City adopted a Master Policy Declaration Statement for Annexation with certain amendments thereto in accordance with the provisions of Part 4 Chapter 2 Title 10 Utah Code Annotated (1953) as amended stating Exhibit "A") showing the bounproposed annexation territory as of daries the Rural Residen- (RR) zone district upon incorporation into the City boundaries NOW THEREFORE BE IT ORDAINED by the City Council of the City of Delta Utah: The corSection Territory Annexed porate limits of the City of Delta Utah are hereby extended to accomplish an annexation of the territory described in the annexation plat attached as Exhibit "A" hereto: that the annexation of provided however territory shall be effective only upon completion of the following: a Publication of this ordinance or a summary thereof as required by Utah law b Certification by the Mayor and City Recorder of the annexation plat (attached tial Delta City e The cost to Delta City of delivering services to the annexation territory will not exceed the revenue lost from taxes to other sources by any affected entity presently providing services to the nexation area as defined in Section Utah Code Annotated (1953) as amended f The territory described in Exhibit "A" is being annexed for the purpose of promoting development of additional residential housing and to facilitate development and improvement of the delivery of water sewer and other municipal services to properties already developed and lying within the annexation territory The territory is not being annexed for the sole purpose of quiring municipal revenue or for retarding the capacity of another municipality to nex the same or rela'ed territory g Upon satisfaction of the conditions set out in this ordinance and the annexation agreements and other documents authorized by this ordinance this annexation will comply with the requirements set out in the Delta City Master Annexation Policy Declaration and other annexation policies of Delta City Section 6 Conditions lo Extension of Municipal Water and Sewer Service and Drainage The City of Delta shall in no event be required to extend further municipal water and sewer service to the annexed territory except upon compliance with the following conditions precedent: a Water Service The annexation petitioners shall install at no cost to the City established all Improvements as necessary by the City Engineer to assure adequate culinary water supply and fire flows in the annexed territory prior to receiving water service in the annexed territory except as otherwise specifically approved by the City Council Neither the annexation petitioners nor their successors shall be entitled to any new connections to the City water system other than existing connections except upon to the City of all water conmaking payment nection fees including a water rights development fee or dedication of water rights in lieu of such a fee whichever is approved by the City Council as a condition of receiving culinary water service from the City of Delta in the annexed territory Payment shall be made to the City prior to receiving any water service except such temporary construction water as may be installterritory puisuant to Delta City water department regulations b Sewer Service The annexation petitioners shall be required to construct such in accordance with City sewer line extensions standards and requirements as will be ed in the annexed to the new sewer service to provide necessary annexed territory except as may be otherwise specifically approved by the City Council The annexation petitioners shall be titled to sewer service only through such sewer main extensions c Storm Drainage The annexation petitioners shall be required to bear the cost of for storm any improvements necessary drainage and conveyance of storm runoff from the annexed territory as shall be Delta City Council proved by the Petitioners or their successors shall be quired to pay such connection fees as may be in effect for users of the Delta City water and sewer systems at such lime as connections are made to those systems Section 7 Zone Classification of Annexed Territory Upon completion of the nexation of the territory described in this dinance into the City of Delta the annexed territory shall be included within the zone district identified and referred to as the Rural Residential (RR) Zone as established Utah by the Zoning Ordinance of Delta (Ordinance 8 Development Restrictions In Section order to assure that the health safety and welfare of the persons residing within the present corporate limits of Delta City and those residing within the annexed territory the City Council hereby establishes the following development restrictions for development of the annexed territory: a Approval must be obtained from the appropriate municipal agencies for any development within the annexed territory and all development must be made in compliance with the guidelines procedures and regulations adopted in the ordinances resolutions and policies of Delta City Any requirements of this paragraph or the municipal regulations incorporated herein not permissable under the laws of the State of Utah are deemed waived b Development must be conducted within the annexed territory in a manner that is aesthetically harmonious to the extent propriate with the rural character of the area immediately surrounding the annexed territory and the character of the City of Delta in general Section 9 Statement of Compliance with Delta City Annexation Criteria The annexation provided for herein complies with the annexation criteria established by City of Delta in that: a The annexation complies with the Utah statutory requirements for annexation as described in Section above b Delta City presently delivers municipal services into the proposed annexation ritory by delivery of municipal water service irrigation water sanitary sewer service delivery police protection and fire services which are delivered in conjunction with Delta Millard County City has delivered such services into the annexation territory for an extended period of time The City Council finds that completion of the proposed annexation will improve the delivery of such services c The annexation has already territory ex perienced urban development and can reasonably expect to have urban developdue to its location and the recent provement of road access into the annexation territory In as much as the annexation territory has already experienced urban development appropriate for annexation of the same into Delta City to provide for appropriate deliver of municipal services and equitable sharing of the burdens of said services The annexation
