Show The Salt Lake Tribunt, Orlohtr Thursday, Dll 16, IW6 UP&L Asks County to join Suit Over Marketing of Federal Power By Jack Fenton Tribune Staff Writer Utah Power & Light Co. is about to file a landmark civil suit challenging the way cheap federal power from Flaming Gorge and Glen Canyon Dams is marketed, Salt Lake County commissioners were told Wednesday. The county has until Friday to join the action, according to Milt Hokan-soUP&L government relations specialist Commissioners indicated their decision will be based on advice from county attorneys The county was one of 141 local governments in the utilitys distribution area to sign resolutions attacking WAPA marketing of the lower-cos- t power. Many of those cities, towns and counties have agreed to join the court test, Mr. Hokanson noted Victory in court, he said, could mean a 20 percent savings for UP&Ls residential ratepayers. Sidney G. Baucom, UP&L execuand general countive sel, told commissioners m a letter that WAPA "made it clear . . . preference in federal power sales (would go only to those counties, cities and towns which own . . . distribution systems. The proposed criteria effectively deny the great majority of electric customers m Utah and other locations within WAPA's marketing area opportunity to receive . , , relatively inexpensive government-producepower " UP&L, Mr Hokanson Explained, contends its franchise from the county and the commission's 1983 resolution criticizing WAPA distribution make it the countys municipal With demands exceeding supplies, a UP&L victory would mean higher-price- s for public power customers This is the first such challenge, Mr Hokanson said He predicted precedents would be applied across the country. Defendants will include the federal energy department, Secretary John allocation inasmuch as requests for power by those public entities ... exceed the power available Other possible challenges include WAPA activities UP&L believes exceed statutory authority and contentions the marketing agency violated federal environmental laws and policies Harrington, WAPA, and majbe others The utility will be represented by Mr Baucom and Jones, Waldo, Holbrook & McDonough, a local law firm, the letter said. Asbestos was not used in building construction after the 1970s, but the Health Department report said the threat can linger for years because of the ease with which the microscopic crystals can get airborne and stay airborne The threat of asbestos is insidious crystals are colorless, odorless and often microscopic. Asbestosis or mesothelioma will develop 20, 30 or 40 years after exposure. Even common floor tiles contained asbestos at one time, but it is not this type of material frithat is most dangerous able asbestos is the real threat, Mr. Taylor said. The easily crumbled asbestos is found most often in insulating coverings such as pipe insulation, boiler tank coverings, duct insulation and troweled-o- n ceilings. Probers categorized buildings in five groups, with 23 areas within 187 buildings being ranked as A", or top priority hazards Some of these areas, though critical m nature, were relatively small in square footage. For instance, a residential building in Box Elder County ranked as an A with only four square feet of material discovered. In all, the survey found five million square feet of asbestos insulation or coverings. Board members heard the report, but could take no action. There is no appropriation for asbestos removal and covering. They said they are contemplating asking the legislature for an ongoing statewide appropriation for asbestos correction, similar to the annual roofing and paving appropriation. ?LUXURYWUAINTHeATRES) STIRtO I1 CROSSROADS CINEMAS Great Salt Lake Starts Its Rise The winterlike temperatures 00 ffSOATO to wW.ikM!,iAi Am State Asbestos Cleanup Might Cost $30 Million ysis. One problem with asbestos is that it takes expert microscopic examination to identify; many look alike substances exist m buildings and can be taken for asbestos by untrained persons. Of the 499 buildings inspected only a fraction of the states thousome 189 were sands of buildings found to have asbestos-containinmaterials (ACM). Workers concentrated on sampling buildings where the danger would be the greatest 14 TODAY IN DOlBY (PG) I? 20 ? 44 Tribune Staff Writer Direct and indirect costs of cleaning up hazardous asbestos in state buildings could run as high as $30 million, members of the state Building Board were told Wednesday. The hazardous material is found in hundreds of state buildings and presents health threats ranging from mild to serious, depending on a building's usage and the condition of the material. The estimate is the highest yet given by state officials, and is by no means final nor complete. Neil Taylor, hazardous substances coordinator, Utah Department of Health, presented board members with copies of a preliminary report compiled over the past several months by state inspectors. The $200,000 study required probers to visit nearly 500 state buildings, often using respirators and disposable clothing to take samples for lab anal- HI U4 TODAY AT 7 (PG) MS INO TMl U 800 00 7 AT (9 uTXiUI PIOPU m COMMON "NOTHING 4.UI By Dave Jonsson The company will pay all legal fees ... coordinate the litigation, including filing a complaint and making decisions as to discovery and motions, Mr. Baucoms letter explained.
