The truth is that the prosecution fell far short of this claim, and the American public and the cause of justice were by the resolution of the case. The report concluded that the department failed to prosecute Hutton officials who knew of the overdraft-in- g and tried to block the congressional inquiry into its handling of the case. The Justice Department response to the conclusions, while far shorter than the voluminous House report, was equally sharp in tone. It is a political report that lacks intellectual honesty," said John Russell, a department spokesman. The House Judiciary Committees subcommittee on crime approved the vote, with the four report by a Republican members dissenting. The Republicans released a lengthy written statement of opposition that praised the Justice Department. The report probably wrote the final chapter in the controversy surrounding the prosecution of one of the most widely publicized white-colla- r crimes in history. The report came nearly a year and a half after Hutton pleaded guilty on May 2, 1985, to 2,000 counts of mail and wire fraud and agreed to pay a $2 million fine and make restitution to the banks it had victimized. The main thrust of the plea was that Hutton had obtained up to $10 loans from billion in interest-fre- e dozens of banks from 1980 to 1982 by systematically overdrawing its bank accounts and purposely delaying the clearing of its checks. The failure to prosecute any Hutton employees, as a result of the plea bargain, drew sharp criticism on Capitol Hill and prompted Rep. Wilchairman of the liam Hughes, House subcommittee on crime, to open hearings last year into the Justice Departments handling of the case. In testimony last year, Stephen Trott, who was head of the criminal division at the time of the prosecution, told the subcommittee evidence was insufficient to prosecute high-levHutton officials and the plea bargain represented a comprehensive settlement of the case. But the report called the penalties a slap on the wrist and accused the Justice Department of violating its internal guidelines by granting im-nilly to too many Hutton employees and failing to pursue evidence were aware of the that higher-up- s scheme.
