northern Utah copper mine without participating in the federal government's Superfund pro- gram That would set a national precedent if approved State and federal regulators are discussing the idea with Kennecott and appear to like the concept but Utah environmentalists are uneasy "We absolutely believe the Susituaperfund program is a tion for everybody" said Gregory H Boyce spokesperson for Kennecott He contends the Superfund process would be a slow and inefficient way to clean up the potentially hazardous mill tailings and reservoir sludge on Kennecott's property The federal program relies on a complex bureaucratic process in which dozens of studies must be completed and meetings held before the cleanup is started Many Superfund cleanup projects have become mired in complicated lawsuits If applied to Kennecott's numerous waste sites along the Oquirrh Mountains Mr Boyce predicted the cleanup process could drag on for decades "Kennecott has the financial no-wi- Vero al- ment" on Kennecott's are expected until late proposal January of early February Alan Miller director of the Utah Environment Center has No decisions doubts His group has criticized a proposed $12 million settlement between Kennecott and the state for groundwater contamination in Salt Lake County claiming the payment is far too low Mr Miller fears that more of these problems could arise if the company is not required to abide by the Super-fun- d n process Kennecott has proposed to enter into a legally binding agreement with both the state and EPA that establishes a process for studying and cleaning up its hazardous-waste sites The scope of this agreement is still being negotiated but Mr Boyce said Kennecott has recommended that it include the mill tailings along Bingham Creek that have contaminated yards in West Jordan contaminated sludge from the bottom of Kennecott's reservoir near Copperton evaporation ponds near South Jordan mill tailings near Lark and mill tailings in Butterfield lead-ric- h wherewithal and engineering skills to do it quickly Why wait?" he said Robert L Duprey hazardous waste management director for the US Environmental Protection Agency in Denver confirmed Tuesday that his agency and the Utah Department of Environmental Health have been negotiating this issue with Kennecott for about nine months He agreed the Superfund program is slow and said EPA is inter Canyon EPA is also believed to be con- sidering long-tercleanup plans for other parts of Kennecott's operation including the massive tailings pond near Magna The pond is still in use but starting a brush fire in American Fork Canyon last August US District Judge David K also ordered Rex Don Tomlinson to pay a $200 fine and to serve 100 hours community service on the defendant's guilty
