She filed charges against the company and was awarded back wages. Had the firm not settled, however, she would have to hire a lawyer to argue her case in a formal hearing. "We tell people to let us have first crack before they hire a lawyer," said Mr. Medina. Many times, companies will settle long before the process gets to the formal hearing stage. In 1983, 33 discrimination cases were processed or completed each month statewide. The average processing time, from intake to conclusion, was 74 days, two days less than the previous year. Total cumulative dollar benefit for charging parties last year was $483,255. Average cost to companies and individuals charged with discrimination was $1,331 per charge. The number of charges filed with the division totalled 478. Sex charges, including equal pay, harassment and promotion denials because of sex, made up 37.2 percent of the filings. Charges involving discrimination because of age comprised 20 percent of the complaints. National origin charges made up 17.6 percent and racecolor complaints were 7 percent. Retaliation charges comprised 7 percent of the filings, complaints involving handicaps were 3.8 percent and sexual harassment charges were 3 percent. Religious discrimination totalled 3 percent of the charges. Settlements Vary About half the cases were settled. Settlement may involve an award of back pay, a promotion, a rehiring or a letter of recommendation. Tne complaints we get are the tip of the iceberg, said John Medina, director of the Labor and divisions with the Utah Industrial Commission. "The problem is that few people know we exist." Most people who complain, said Mr. Medina, are those who have quit their jobs or who have been fired. Workers who remain with a firm are often less likely to file discrimination charges against their company, although it happens. We explain to employees that filing a complaint against a company they still work for isn't going to be easy, said Mr. Medina. Weye charged companies with retaliating against complaining workers, but we want workers to understand all that could be entailed before they file a complaint. Officials from the Division will speak to emwithployers, firms and workers to explain laws out charge prohibiting discrimination. For more information, contact Mr. Medina at the State Industrial Commission. J -- For discrimination complaints to come under the states jurisdiction, an offense must be reported within 30 days in a firm employing 25 or more workers. The federal government investigates charges within 180 days of the incident or, in some cases, up to 300 days in companies that employ 15 or more employees. State officers will work toward a settlement, asking for what the worker and the company believe is fair. If the employer or worker does not agree with the findings of the PCKET WATCH the cases were closed because the complaining workers could not be located, they failed to cooperate or they did not report the offense in the stipulated time. If discrimination is suspected, first talk to the offending party and then to the boss, said Mr. Medina. If the offense is repeated, go to a supervisor. "Many cases are settled long before a formal hearing, especially in cases involving sex discrimination," said Mr. Medina. Company officials don't like the embarrassment of a hearing. Mr. Medina said companies can save time, money and lawyer fees if supervisors and managers understand that avoiding discrimination is cheaper and less embarrassing for employees as well as for themselves.
