Judge Ends Divorce Battle , Divides Up Toy Trains By Julia Martinez Associated Press Writer A judge ended a DALLAS divorce battle by granting visitation rights to both the husband and the wife to more than $4,000 worth of toy trains. In our better days we jokingly said we could divide up the kids, but never the trains, Sondra Kay Buckner, 43, said Thursday. The north Dallas couples two children are grown. State District Judge Josh Taylor last week awarded Mrs. Buckner 1935 Comet custody of the aqua and silver engine, three pasgreen senger cars, a three-piec- e tunnel, bridge, a standard-gaug- e two street lights, toy baggage men and baggage worth $500 to $1,000. She wanted the little corpulent people, too, but he got those, said Joseph V. Semon, attorney for Noel Harlan Buckner, 48. Buckner also got the American Flyer train set with the orange water tower, coal loader, log car, red caboose, Lionel billboards, animated newsstand, tunnel, plus 25 train catalogs, workbooks and planning books, as well as 25 sections of Mighty Casey track. six-mon- th tin-plat- When 12 containers of scenery material for trackside, one train place mat, the dispatchers phone and the engine oil can are figured in, it comes to nearly $4,000. Although Buckner got most of the trains, his wife won custody of the couples house. I wanted some of the trains but I needed the house, Mrs. Buckner explained. Buckner wouldnt comment on the case. Judge Taylor said the Buckner case was the first in which he granted visitation rights to a train. "It sometimes happens with dogs or something like that, he told the Dallas Times Herald. But Tve never heard about a toy train. But, then, theyre both pretty involved with them.;: Mrs. Buckner said the first train set was a Christmas gift to her son, now 22, about 11 years ago. However, shq and her husband got hooked on them. They later graduated to collecting more sophisticated gauge and antique varieties. We even owned a Z gauge. Its so small you can do a whole layout in a briefcase, she said excitedly. "A lot of executives have these trains in their briefcases. Mrs. Buckners son has his own train set now and her daughter isnt really interested in them, she said. Under the terms of the settlement, Mrs. Buckner will get the right to visit the trains her husband received twice a year as long as she gives 24 hours advance notice by telephone and the time is convenient for him. What will a visit to the trains entail? "Well, Ill run them, look at them, enjoy them, Mrs. Buckner sid. By David Espo Associated Press Writer Walter F. Mondale said Friday that Gary Hart should apologize for criticizing the Carter administrations handling of the Iranian hostage crisis, and the Rev. Jesse Jack-so- n watered down a key demand for election law reform as the Democratic presidential campaign neared judgment day in Texas and Louisiana. Hart brushed aside Mondales call for an apology, saying, Was he not vice president? at the time of the crisis. He cant run on the basis of experience and not accept the responsibility, the Colorado senator declared in a day of campaigning in the Midwest. Mondale, setting out on a five of Texas on the day before city-tothe caucuses, said, I believe Gary Hart made a very serious mistake with his remarks critical of former President Carters performance in the Iranian crisis. The Colorado senator would be well advised to apologize, he said. Texas Democrats will allocate 169 delegates at their caucuses Saturday, while Louisiana apportions 57 delegates in a primary election the same day. Mondale is favored to win both contests, although Jackson has campaigned hard in Louisiana and Harts Texas coordinator, Rep. Martin Frost, is predicting an upset victory in that state. Hart badly needs a victory to revive his fading campaign, both for the convention delegates it would bring and for the momentum it would mean for next Tuesdays primaries in Ohio, Indiana, North Carolina and Maryland. Mondale now has 1236.05 delegates, with 670.75 for Hart and 208.2 for Jackson. It takes 1,967 to win the nomination. Hart of Foiled Burgl ars FlOe Car, Run Right Into San Qu entin Prison A Gang CORTE MADERA, Calif. (UPI) -gang of suspected burglars fleeing police drove their car into San Francisco Bay Friday morning, got out of the submerged car, ran across a field and scrambled under a fence straight into San Quentin prison. The wild chase began early in the morning at the offices of Handi-Cu- p Corp., which manufactures styrofoam cups. An employee opened the door to his office, saw a stranger in the corner, and backed out. He called police, then walked down a hall where he surprised two more men. The three burglars jumped into a A green Buick and sped off with a Corte Madera police car not far be- hind. The chase led down a winding road toward a bridge that links Marin County, which is just north of San Francisco, with the East Bay. Somewhere, around one of the sharp curves, the Buick disap- peared. Officer Gary Cusimano said the car apparently missed the curve, hit an embankment and flipped off the road into the Bay. But the pursuing officers did not see the accident and roared by onto the bridge at 90 mph. The suspects meanwhile got out of Hunt the car, waded through the water and mud, and headed toward what they thought was safety They crawled under a barbed wire fence surrounding the prison. President Reagan seems to think deficits are the workers salvation. The truth is that are the workers devastation, Hart said. Put bluntly, the deficits are Ronald Reagans economic Vietnam. In another campaign development, House Speaker Thomas P. ONeill said Rep. Geraldine Ferraro, is his personal favorite for the Democratic vice presidential disnomination. ONeill, closed his choice to the Boston Globe. Both ONeill and Ms. Ferraro have endorsed Mondale for the presidential nomination, and Mondale says he will give serious consideration to a woman running mate. Hart was in Cincinnati during the day, where he toured a printing plant with old fashioined and high speed, modern printing presses. He said the old political leadership, President Reagan and the leaders of my party, dont understand this revolution in the American economy. But it was his remarks earlier in the week about Iran that drew Mondales fire. Hart said in College Station, Texas, that the Carter administration gave us an America held hostage to the ayatollahs of the world, and he urged the nation to remember those days of shame. State Bar May File Charges Court Fails to Convict Impeached Official - A divided LINCOLN, Neb. (AP) Nebraska Supreme Court on Friday acquitted state Attorney General Paul Douglas of misconduct and improper financial dealings, but said he still could face criminal charges or disciplinary action by the state bar. Douglas, 56, a three-terRepublican once seen as a possible candidate for governor, had been impeached by the legislature for allegedly taking insider loans from a savings company and engaging in improper real estate transactions with a bank official. He also was accused of misrepresenting what he knew about the case. viction; four did on the mispresenta-tio- n charge. Douglas on March 14 became the first Nebraska official impeached this century, and he had been suspended with pay since then. State Sen. Ernie Chambers of m The allegations were civil charges, but under the Nebraska Constitution impeachment is a criminal-styl- e proceeding in which a defendant must be found guilty beyond reasonable doubt to be convicted. Although a majority of the court believed Douglas was guilty of the vote fell one short of the legal requirement for a guilty verdict. The court unanimously absolved him of the insider borrowing charge and three other charges, while three justices voted to find him guilty of lying about his knowledge of a land deaL Since there was not a concurrence of five or more judges to find the defendant guilty on any specification, it is the judgment of the court that the defendant is not guilty, said the opinion signed by the court. The defendant, however, is subject to prosecution and punishment according to law, and, as a member of the bar, may be subjected to sanctions which may be imposed in a disciplinary proceeding. Five of the seven judges would have to have voted guilty for a con- - I Mimicking A1 Jolson Gets Policeman Fired BALTIMORE (AP) - A police- imitations of A1 man, whose Jolson in blackface left him at odds with department superiors in this city where blacks are a major ty, was dismissed Friday by the police commissioner. off-dut- y Commissioner Frank Battaglia ordered Officer Robert Berger fired immediately, according to Dennis Hill, a police spokesman. Hill said Berger, 35, had been fired because of a willful disobedience of a direct order by his commanding officer that he not appear in blackface on three dates in March. A police disciplinary board voted unanimously Wednesday to recommend dismissal of Berger, who is a police veteran, according to Millard Rubenstein, an attorney representing the police department. Rubenstein said at the time of the decision that the recommendation was based on Bergers failure to follow an order three times following a federal judges ruling in the case. U.S. District Judge Walter Black decision issued Jr., in a March 21, ruled that the police department had a legitimate interest in regulating Bergers off-dut- y Omaha, who introduced the impeachment resolution, said Douglas was totally discredited and should resign immediately. Douglas, however, said he would not resign but go on with my sworn duties and responsibilities. If he had been convicted, Douglas would have been removed as attorney general and barred from again holding public office in Nebraska. He was found innocent of allegations involving Commonwealth Savings Co. of Lincoln, an industrial loan and investment firm that was declared insolvent by state banking officials on Nov. 1. Douglas was accused of receiving insider loans with favorable rates and special privileges such as freedom from repayment schedules. He also had been accused of using Commonwealth funds in real estate deals with Marvin Copple, a former Commonwealth vice president. Im pleased of course that I am still the attorney general, I have to be pleased about that, Douglas told The Associated Press. I suppose my other statement would be that what I intend to do now is go on with my sworn duties and responsibilities as the attorney general. He did not speculate on the courts mentioning he could still be the subject of legal or bar association action. I but dont know what theyre saying Im very optimistic, he said. If Douglas were disbarred, he still could remain as attorney general since state law does not require that the post be held by an attorney. For years, Douglas has been regarded as a potential GOP gubernatorial or senatorial candidate, but he always disavowed interest in either job.
