Compton also testified that the amount of interim relief granted should not be the amount necessary to allow the Company to earn its authorized return on equity for the test period because of current improvements in interest rates, both long and short term. Witness Compton further testified that certain indicators or benchmarks should be considered in determining the appropriate level ot rata relief granted. These benchmarks consisted of: (I) a ratio of one over the long run, (7) earnCompany market-to-booings on common to equal the Company's current dividend; (3) last year's achieved return on to the repeat Company's earnings equity; (4) earnings to reach the industry average achieved re(5) earnings to achieve the inturn on equity of 12 1 to 13 dustry average debt coverage of 31 times; and (6) internally of the Company's construction generated funds to equal 35 budget. The Division witness testified that the benchmarks were roughly in order of importance but that for this particular case and current circumstances, the greatest weight should be given the second. With respect to the second benchmark, he indicated it was important that the Company maintain the current pavout ratio of one, but that the payout ratio shouldn't just be achieved through "Utah generosity," which he testified would current payout ratio of one, but that the payout ratio shouldn't iu$l be achieved through "Utah generosity," which he testified would require a 862 million interim grant bv the Utah Commission, and that tha Utah revenue contribution would be approximately 843 million if equaled bv the other iurisdictions' earnings. The Division, accordingly, recommended an award of 843 million. Several public witnesses testified who were opposed to tne requested rate increase. Based upon the record to date, the Commission makes the following Findings of Fact and Conclusions: FINDINGS OF FACT 1. Notice of hearing in this case was issued by the Commission on September 30, 1982; it was published in newspapers of general circulation in Applicant's service area; and public hearings were held on October 22. 26 and November 2, 1982 2. Based upon a test year ending August 31, 1983, Applicant requested annualized interim relief of 885,161,000. 3. The rate of return on equity most recently authorized bv the Commission for UP4l is 16.3 (Case No. 4. The Company, without interim relief and based uoon estimated earnings for the test period ending August 30, 1983. would earn a return on rate base of approximately 8 48 and a return on equity of approximately 7.45. 5. Without interim relief, the Company will not earn its dividend for the test year period and at the current rate ot decline m coverage ratios mav well impair its ability to issue new debt securities in the test period 6. The financial benchmarks proposed bv the Division are reasonable benchmarks for considering the appropriate level ot rate relief for the Company in this case. 7. The Commission finds that the following facts and circumstances are relevant to the determination of the amount of interim rate relief that UP4L should be granted in this case: a) Inflation in the general economy continues at a rata that, while less than previously experienced in the recent past, contributes to an adverse attritional effect on the ability of the Company to earn its authorized rate of return without periodic adiustments; b) There is some indication that the cost of capital, and long term interest as measured by both short-terrates, mav be improved somewhat since the Commission determined 16.3 to be a reasonable return on equity in connection with Case No. c) The Company's construction program is substantial, and will continue to require large expenditures during the test year. The Company is looking to finance $360 million in new construction during the test year, and those sums are obtained through the issuance of securities and investment of earnings. While customers do not pay the direct costs of construction, they pay the carrying costs of borrowed money in addition to the allowed rate of return on utility rate base. With respect to this rate case, approximately 826 million of the 8105 million requested is directly attributable to the inclusion of the Company's Hunter No. 3 generating plant in rate base for the last three months of the test year; and d) it is likely that the Company will continue to require substantial rate increases. Significant evidence was presented that the impact of continued and substantial rate increases is working great hardship on an increasing number of people in Utah. The Commission is particularly concerned that federal funding of Low Income Energy Assistance Program grants appears to be diminishing. While we do not deem the Commission s function to be that of determining means for redistributing income to effect social welfare purposes, we note tor the record that a failure of the Congress and the State Legislature to adequately address the plight of low and fixed income customers through some form of direct assistance will inevitably result in the Commission functioning as a court ot last resort to solve, through the ratemaking process, the very difficult and tragic problems of people who cannot afford necessary utility service. We further note that our decision not to implement lifeline rates was based in considerable part upon the prospect of continued L.I.E A P. funding It is clear that the problems thus posed can be solved either bv the Commission or bv the Legislature; because of the broad policy issues therein raised, we believe the most appropriate forum to be the Legislature and a consensus of the Should the legislature voters' elected representatives. choose not to act, the issue will then fall to the Commission for analysis and solution. 8. CONCLUSIONS OF LAW 1. The Commission has the authority to grant interim relief to UPAL Pursuant to Utah Code Ann. ss (Supp 1982) which provides as follows: The following rules shall apply with respect to implementation of any proposed rate increase filed bv a utility or such other increase in lieu of that prooosed bv a utility which is determined to be iust and reasonable bv the Commission: (a) The Commission, on its own initiative or in response to an application by a public utility, may allow any proposed rate increase or a reasonable pari of it, subiect to the Commission's right to order a refund, to take effect upon the filing of its schedules or at any time during the pendency of its hearing proceedings. (See in Re. Utah Power 4 Light Company, Case No Report and Order on Interim Rates dated December 1, 1981). The interim rate statute is designed to permit interim rate increases subiect to refund and prior to completion of formal hearings in order to allow utility companies necessary rate increases on a timely basis. 2. A lawful procedure is available to make refunds to customers who may be temporarily charged more than ultimately found to be iust and reasonable upon the completion of the full hearing process. 3. The hearings, and evidence received in this case, to this point are adequate, under the aforementioned statute, to provide a basis for a Commission decision on interim relief for the Company. 4. The Company's application, including prefiied testimony and the evidence adduced at the hearings, provide an adequate basis for a Commission decision concerning the need for and the amount of an interim increase. The Commission is not deciding in this case whether the interim rate statute requires a formal hear-inor if an interim increase can be implementated bv the Commission without a hearing. 5. Typically the burden of presenting support and foundation for an interim increase rests upon the utility. In granting an interim increase in this case, the Commission feels that the Company has presented a prima facie case establishing that UPAL's present rates are inadequate to provide a realistic opportunity to earn a reasonable rate of return on its common eauity for the test year. 6. We conclude that the benchmarks testified to bv the Division are appropriate at this time in determining the level of interim rate relief to be granted in this proceeding and further conclude that the Utah jurisdiction should not carry other jurisdictions. Accordingly, we conclude that the amount of 849 million is an increase sufficient to provide an adequate opportunity for UPAL to maintain a reasonable return on equity capital for the Utah jurisdiction pending the final resolution of the revenue deficiency phase of the case. 7. It is equitable and reasonable to spread the interim relief herein "across the board" and on an equal percentage basis both among and within the classes of service until the Commission issues its Order in Case Nos at and which time the spread ordered by the Commission in those cases should be applied to the award granted in this case. Bases uoon the foregoing Findings of Fact and Conclusions and pursuant to Utah Code Ann. ss (Supp. 1982), the Commission issues the following: ORDER NOW. THEREFORE. IT IS HEREBY ORDERED, That 1. Utah Power 4 Light Company is hereby authorized to file tariffs for an interim rate increase in the amount ot $49 million The increase shall be spread "across the board" and on an equal percentage basis both among and within the classes ot service until the Commission issues its Order in Case Nos. at which time the spread ordered bv the and Commission in those cases shall be applied to the award granted in this case. 2. The rate increase is subiect to refund 3.
