Attorneys for accused murderer Marc Francis Schreuder said Friday they believe the prosecutor in the case is withholding evidence which may benefit their clients defense. They also alleged that Deputy Salt Lake County Attorney Ernie Jones made "misleading statements in an answer to the Utah Supreme Court which apparently persuaded the justices to deny a defense, motion for a stay in the trial, which is scheduled to begin Monday at 10 a m. R. Paul Van Dam and Joseph E. Tesch, during a hearing before 3rd District Judge Jay E. Banks, said they are upset that Mr. Jones has not supplied them with more reports regarding witness interviews and police investigations into the July 23, 1978. shooting defense motion for a stay in the trial, which is scheduled to begin Monday at 10 a m. Mr Schreuder, 21, along with his mother, Frances Bernice Schreuder, are alleged to have plotted and carried out Mr. Bradshaw's murder because they feared he was gomg to disinherit them. Mrs. Schreuder currently is fighting extradition to Utah from New York. Incensed Over Allegations Mr. Jones, who was incensed over the defense allegations, told the judge hp has fully complied with a court order that he turn over any exculpatory material regarding the Schreuder prosecution. Judge Banks agreed, telling the defense that he "will not require the state to do your home work for you." During the arguments, Mr. Tesch told the court he found it "kind of fishy that the defense had been supplied with a "long list of witnesses and short reports regarding the investigation. "It leads us to believe we have not got all the reports, he said. He also alleged the prosecutor and his investigator, Sgt Mike George of the county attorney's office, "do not put things down on paper to intentionally keep us from having it Counters Argument Mr. Jones earlier said some of the information in the investigation of the Bradshaw murder had not been put on paper, while other information was in the form of working notes, which the judge had not required the prosecution turn over to the defense. He countered Mr. Tesch's argument by stating. "If the defense wants to tell me what it's defenses are. then we'll supply them with the witness statements. Judge Banks said he would not require the state to provide the defense with its "theories and conclusions in the case. Regarding the supreme court issue, a document filed by Mr. Jones as an answer to a defense petition for a stay in the trial date contained an "unwhich indicated intentional typographical error, that the defense had been supplied with all official reports on the investigation in February 1981. In reality, the date was Feb. 26, 1982. Charges were not filed against Mr. Schreuder until June, 1981. Mr. Jones stated. Moves Up Hearing Date "It's no wonder they didn't grant us the stay," Mr. Tesch said, noting that he had approached the court for another hearing on the matter. As of late Friday, there was no indication from the high court that such a hearing would take place. The Supreme Court did, however, move the date for a hearing on a petition for an extraordinary writ scheduled for June 21 up to Monday afternoon. That hearing was the basis upon which the defense had applied for the stay. . ... - Garn Assails Sen. Salt Lake City Police Lt. Keith Tolman said the bank, 1500 S. Foothill Drive (1960 East), received a telephone call at about 12:45 p.m. Friday from a man who told manager Vickie Slighting to put $40,000 in two bank bags and bring it out the north doors of the building. He told her a bomb had been connected to the banks alarm system. Lt Tolman said the manager refused to comply with the caller and was told not to call the police or trigger the alarm. The caller told her she had nine minutes to get the money ready and be waiting outside.
