| Show AN ORDINANCE granting A franchise to george A dixon E S hansen richard west john 0 oyler r jr and J R ashby trustees for and in behalf of the citizens of east garland and to their successors to construct maintain and operate an electric transmission line in box elder county sec 1 the board ot of county commissioners ners 0 of the county ot of box elder state ot of utah ordains as follows thai that george A dixon E S hansen richard ar d west john 0 oyler jr and J R ashby trustees for and in behalf of the citizens of east garland and their successors have the authority and consent of the board of county commissioners and the permission is hereby granted them for the period of 25 years to erect and operate a pote pole line system of wl wiring ing tor for the transmission of electricity oler and along the following roads and highways of box elder county to wit beginning at the northeast corner of see sec 13 tp 12 N R 2 W and running thence south to the southwest corner of see sec 24 tp 12 N R 2 V IV also beginning at the southeast corner of see sec 13 19 3 tp 12 N R 2 W and running thence west IGO rods said electricity to be used for the purpose ot of furnishing power for heating lighting and purposes tor for which electricity is now used or may hereafter be applicable and to supply the inhabitants ot of east garland with pow power er heat and light seca the licenses shall be required to erect strong and durable poles ot of such type and strength as may be suitable for the use to which they are to be applied which said poleg pole shall be placed not ts to exceed feet apart except when nic necessary essary to cross depressions or when any like emergency may arise insulation shall be safe and wires shall be so strong as to be at least 20 feet from the ground sec 3 no pole line shall be erected under th this s franchise until the board of county commissioners or one of their number shall first have indicated the location of such pole line sec 4 that said county shall in no way be liable tor for any accident loss or damage that may occur in tile the construction st or operation of said pole line by the parties herein their successors or of any of their officers agents or employees and the acceptance of this grant shall be deemed an agreement on the part of the grantees granlees Gran tees herein or their successors to save said county harmless from all liabilities loss costs or damage of any nature arising out of the constructing or operating of said pole line system see sec 5 that the said grantees granlees Gran tees and their successors shall at all times conform to such reasonable regulations having regard to the safety and convenience ven vengence veni lence ence of the said highways as the board of county commissioners may from time to time make and order see sec 6 if this grant with the terms and conditions herein contained be not accepted in writing by the said gran tees within 90 days after the passage of this ordinance then this grant shall be null and voids void the rights and eriv leges herein granted are not exclusive and nothing herein contained shall be construed to prohibit and prevent the use e 0 of f said highways with proper authority orl I 1 ty either cither for a purpose similar lar to MILL eliat ivi for which its use Is hereby granted or for any other purpose passed by unanimous vote of the board of county commissioners of box elder county utah this day of may 1912 D B E ADAMS H JOHN F r CONLEY attest alvin epsen clerk dy by george L johnson seal deputy state of utah county of box elder I 1 uvin alvin ipsen county clerk in and for the county of box elder state of utah do hereby certify the foregoing to be a full true and correct copy of an ordinance entitled an ordinance granting a franchise to george A dixon E S hansen richard west john 0 oyler jr and J R ashby trustees for and in behalf of the citizens of E east ast garland and to their successors ces sors to construct maintain and op crate an electric transmission line in ia box elder county as aa passed by the board ot of county commissioners of box elder co utah in regular session may aray ath 1912 9 1 I further certify that upon the passage thereof commissioners D E adams adama H 3 larson and john F conley wore present and par in the passage thereof ind and each voted aye witness my hand hamd and seal this day ot of august A D 1912 ALVIN IPSEN seal county clerk by GEO L JOHNSON deputy |
