the executive of !he rest of the city's departments and agencies and holds veto power over City Council decisions he contends that he has no real authority over the RDA Meanwhile some businessmen have contended that the downtown community has little say over what the agency does and three members of the City Council Tom Godfrey Sydney Fonnesbeck and Roselyn Kirk have said publicly they're not being informed of all aspects of the agency's operation Their colleagues on the council particularly RDA Chairwoman Florence Bittner have denied the assertion The argument among the council probably stems from the January election of Councilman L Wayne Horrocks to the vice chairmanship of the RDA board In the council's first 10 years its members operated under an informal agreement that the RDA's chair r terms so that and vice chair should serve both would gain a solid working knowledge of the agency Mrs Kirk had completed one year as vice chair of the board when council members called for the election of officers for the current year Mrs Bittner was chairwoman of the board but Mr Horrocks was elected vice chairman The vote also meant that Mrs Kirk Mr Godfrey and Ms Fonnesbeck the councils three senior members no longer held leadership positions on the council or the RDA board The vote also at least indirectly led to a council imbroglio in March in which Mr Godfrey publicly aired a rumor during debate over an RDA issue During debate over whether the agency should honaoreement to sign a contract with or a Zions First National Bank and Smith Capital Markets to be financial adviser on a bond issue Mr Godfrey said he'd heard a rumor that a councilman had talked to a principal of the group about the deal Mrs Bittner and Councilman WM "Willie" Stoler acknowledged after the meeting that they each had talked to a Zions official but denied that any sort of deal had been discussed The airing of the rumor so angered Mr Stoler that he asked for an independent investigation into the rumors source Former deputy attorney general James L Barker : ' conducted the investigation for free and found that no violation of the stae's open meetings law had occurred He also told the council he believed be knew where the rumor started but declined to name the source The rumor also spurred the first public calls to change the way the RDA is governed Former City Commissioner Jess Agrraz was one of the first to say that a panel similar to the Airport Authority board should be established to advise the City Council on RDA matters The proposal has gained strength as the year has worn on Mrs Bittner as the agency's chairwoman has opposed the idea arguing that finding people for an advisory board who had no conflicts of interest would be a difficult task Meanwhile Mayor DePaulis criticized his lack of authority over the agency In May he made several proposals to increase his authority including Mr Agraz's proposal giving him a vote on the RDA board or giving full executive authority including veto power The last two items would require a change in state law but no legislation has been drafted by the City Attorney's Office to date But the agency faces more issues than who may or may not control it in the future Although the two new office buildings and the new Jazz arena will add an estimated $2 million in tax increment to the RDA's $8 million annual income the money may not be enough to fund all the proposed downtown projects The agency must repay bonds issued to improve Block 57 and buy land and make improvements for the new Jazz arena which will cut into RDA coffers for the next 20 years Mr Chitwood said If the agency takes on too many projects it would lose its flexibility to consider new proposals he said Another factor that will change the way the agency
