Frances R. Purdie brought the suit when she learned she was denied entrance to graduate study because she was 51 years old. Attempts to have the decision reversed have failed in lower courts and the case is being appealed to the Supreme Court. Lawyers for Mrs. Purdie and the state had earlier agreed that the sole issue in the case was whether age basis for the university not is a reasonable considering Mrs. Purdie for graduate admission. She already holds a masters degree in social work. Attorney Brian Barnard, representing Mrs. Purdie, told the high court that age is a shaky reason for making classifications among persons. To discriminate against certain age persons, the state would have to have compelling reasons, he argued. Just like race and gender, he said, a persons age is something over which he has no control. But, he' conceded, there is not legal precedent backing his claim that age is a suspect classification." Assistant Attorney General Brinton R. Burbidge said the universitys position is to give preference to young applicants because they be can be expected, ultimately, to return more to society through their advanced education than one who gets that education in the middle years. He said on questioning that the university doesnt have a specific age policy for admissions. Chief Justice A. H.
