Larger floods can and will occur on rare occasions. Fiord heights may be increased by man-mad- e or natural causes. This ordinance does not imply that land or permitted uses outside the areas of special flood hazards or land or uses permitted within the areas of special flood hazards will be free from flooding or flood damages. This ordinance shall not create liability on the part of Kane County, any officer or employee thereof, or the Federal Emergency Management Agency, for any flood damages that result from reliance on this ordinance or any administrative decision lawfully made thereunder. Section 4.0 Administration 4.1 Establishment of Develop- ment Permit review, reasonable utilize, and provide to the building inspector any base flood elevation data available from a Federal, State or other source, in order for the building inspector to administer Section 5.2, SPECIFIC question; existing or proposed structures, fill, storage of materials, drainage facilities; and the location of foregoing. Specifically, the following information is required: (1) Elevation in rotation tri mean sea level, of the lowest floor (including basement) of all struc- tures; (2) Elevation in relation to mean sea level to which any structure has been floodproofed; (3) Certification by a registered professional engineer or architect that the floodproofing methods for any nonresidential structure meet the floodproofing criteria in Section 5.2-2- ; and, (4) Description of the extent to which any watercourse will be altered or relocated as a result of proposed development. 4.2 Designation of the Building Inspector The Kane County Building Inspector is hereby appointed to administer and implement this ordinance by granting or denying development permit applications in accordance with its provisions. 4.3 Duties and Responsibilities of the Building Inspector ' Duties of the Kane County Building Inspector shall include, but not be limited to: Permit Review (1) Review all development permits to determine that the permit requirements of this ordinance have been 4.3-- 1 satisfied. Review all development permits to determine that all necessary permits have been obtained from those Federal, State or local government agencies from which prior approval is required. (3) Review all development permits to determine if the (2) proposed development adversely affects the flood carrying capacity of the area of special flood hazard. For the purposes of this ordinance, adversely affects" means damage to adjacent properties because of rises in flood stages attributed to physical changes of the channel and the adjacent overbank areas. Alternation of Watercourses (1) Notify adjacent communities, the Army Corps of Engineers, the Utah State Engineer and the Division of Water Resources prior to any alteration or relocation of a watercourse, and submit evidence of such notification to the Federal Emergency Management Agency. (2) Require that maintenance is provided within the altered or relocated portion of said watercourse so that the flood carrying capacity is not diminished. 4.3-- 4 professional engineer) for the proposed development shall be required. (iii) If the proposed development is a building, then the provisions of this ordinance shall apply. 4.3-- 2 Data Use of Other Base Hood When base flood elevation data has not been provided in accordance with Section 8.2, BASIS ESTABLISHING THE AREA8 OF SPECIAL FLOOD HAZARD, the developer or applicant shall obtain. : of special flood hazards where base flood elevation data has been provided as set forth , Use of Other Base in Section Flood Data, the following standards are required: 5.2-- 1 Residential Construction New construction and substantial improvement of any residential structure shall have the lowest floor, including basement, elevated to or above base flood elevation. 5.2-- 2 Nonresidential Construction New construction and substantial improvement of any commercial, industrial or other nonresidential structure shall either have the lowest floor, including basement, elevated to the level of the base flood elevation; or, together with attendant utility and sanitary facilities, shall: (1) be floodproofed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water; (2) have structural components capable of resisting hydrostatic and hydrodynamic loads and effect of buoyancy; and, (3) be certified by a registered professional engineer or architect that the standards of this subsection are satisfied. Such certifications shall be provided to the officials as set forth in Section 4.3-3(2- ). Interpretation Boundaries Make interpretations where where needed, as to the exact location of the boundaries of the areas of special flood hazards (for example, where there appears to be a conflict between a mapped boundary and actual field conditions). Section 5.0: Provisions hazard Reduction Standards In all areas of special flood hazards the following standards are required: 5.1-- 1 Anchoring (1) All new construction and substantial improvements shall be anchored to prevent flotation, collapse, or lateral movement by p and frame providing ties to ground anchors. Specific requirements shall be that: over-the-to- ties be provided (i) at each of the four corners of the over-the-to- p mobile home, with two additional ties per side at intermediate locations, with mobile homes less than 50 feet long requiring one additional tie per side; (ii) frame ties be provided at each corner of the home with five additional ties per side at intermediate points, with mobile homes less than 50 feet long requiring four additional ties per side; (iii) all components of the anchoring system be capable of carrying a force of 4,800 pounds; and, (iv) any additions to the mobile home be similarly anchored. Construction Materials and Methods (1) All new construction and substantial improvements shall be with materials and constructed utility equipment resistant to flood damage. (2) All new construction and substantial improvements shall be constructed using methods and practices that minimize flood damage. 5.1-- 2 Utilities (1) All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of flood waters into the system; (2) New and replacement sanitary sewage systems shall be designed to minimize or eliminate infiltration of flood waters into the systems and discharge from the systems into flood waters; and, e waste disposal sys(3) tems shall be located to avoid impairment to them or contamination from them during flooding. 5.1-- 3 Subdivislou Proposals (1) All subdivision proposals shall be consistent with the need to piinimize flood damage; proposals (2) All subdivision shall have public utilities and 5.1-- Section 6.0: Penalties Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine not to exceed $299.00 or by a term of imprisonment in the Kane County Jail not to exceed six months, or by both such fine and imprisonment. for flood 5.1 General 4 such as sewer, gas, electrical, and water systems located and constructed to minimize facilities flood damage; (3) All subdivision proposals shall have adequate drainage provided to reduce exposure to flood damage; and. Section 7.0: Validity If any one or more sections, sentences, clauses or parts of this ordinance shall, for any reason be questioned or held invalid, such judgment shall not affect, impair or invalidate the remaining provisions of this ordinance, but shall be confined in its operation to the specific sections, sentences, clauses or parts of this ordinance so held unconstitutional and invalid, and the inapplicability and invalidity of any section, sentence, clause or part of this ordinance in any one or more instance shall not affect or prejudice in any way the applicability and validity of this ordinance in any other instance. and Section 8.0: Authorization Direction To County Officials The Kane County Clerk shall certify to the adoption of this ordinance and cause the same to be published and the officers and officials of Kane County are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this ordinance. Section 9.0: Repealer Any previously enacted ordinances or parts thereof which are inconsistent with this ordinance are hereby repealed, but only to the extent that they are inconsistent with this ordinance. This repealer shall not, however, be construed to revive any ordinance heretofore repealed. Section 10.0: Effective Date of Ordinance This ordinance, after its passage, approval and recording and upon one publication in a newspaper published and having general circulation in Kane County, Utah, shall become effective on July 1, NOTICE TO WATER USERS Notice is hereby given that the following request has been filed with the State Engineer regarding water in Kane County.
