The defendant had previously appeared before the court and five-year-o- ld pleaded guilty and mentally ill to four counts, aggravated robbery, escape, theft and one aggravated assault charge. Before accepting the pleas, Judge Bunnell explained that the prosecution had the burden of proving all elements of the alleged crimes at trial. He advised the defendants that by pleading to the charges, they were waiving all constitutional and legal rights, including the right to trial, the right to testify or not and the right to appeal the matter to an appellate court if they were dissatisfied with the outcome of the trial.
