Show 2 THE GREEN SHEET Thursday, Dec. 29, 1988 E C 1 E Those Constitutional Rights Protected By Public Notice Even before the founding of this great nation, the importance of public notice has been recognized by those who treasure freedom. During that turbulent period of our history when ideas were formulated which later came together as the Declaration of Independence and ultimately the Constitution itself it was the fact that the people were informed which gave our fledgling government the power it needed to survive. Recognizing the importance of public notice, our forefathers included it in the fabric of the Constitution itself as a requirement on d federal government - and the a tradition which newspapers in this country have borne since the very beginning with pride and dignity. The framers of the Constitution realized that the democratic process relies on an informed citizenry and on a citizen's "right to know." Without widespread information on government actions, a free government cannot exist. Without an informed populace, tyranny reigns. With an aware electorate, checks and balances are placed on those in power which even the three branches of our system of government cannot match. Ultimately, the power to govern this land rests in the hands of the people, and the people retain that power by being informed about what government is doing. Public notice can take several forms. When a zoning decision is imminent, for example, laws require that residents living within so many feet of a proposed zone change be informed by mail that the Planning and Zoning Commission will meet at such and such a time and place, allowing those who may have a stake in the outcome of that decision to take whatever action they deem necessary to protect their own inter- - -- newly-create- direct mail. People have confidence in newspapers and read them to find out what is going on in their communities. While often dry, boring reading, these types of public notice serve the purpose of keeping the public informed. Without them, a crucial source of knowledge is missing." un- -' "Public notice" or "legal" advertising like other forms of advertising - is required by law. The federal government and every state require certain public information to be published in newspapers. "Public notice" is as much a part of the American way of life as trial by jury, freedom of the press and due - -- process of law. Public notice guarantees each citizen the security of his constitutional rights. Proceedings such as trustee's sales, adoptions, sheriffs sales, divorce summons and so on are as much a safeguard to the defendant in the action as to the plaintiff. It serves notice to the defendant that he may have his day in court, and it offers the plaintiff the opportunity to exercise his legal rights. These are screamed, spoken and whispered thousands of times each year by student directors of our local1 high schools. These young people contribute countless hours of hard work, sleepless nights and very early mornings to help their high schools produce the best musicals, dramas and comedies possible. Yet each year, as the prestigious Green Sheet Awards are given, these fine people seem to go unnoticed when awards are handed out. As is often the case, the "behind the scenes" people are not given their due. I feel that the awards committee, along with the high school drama coaches and awards judges, could conceivably create an award for these outstanding young people. I am not at liberty to suggest the manner in which this should be done. However, I feel confident the awards committee could find the appropriate action to fit my suggestion. As a parent of two young men who have had the opportunity to be involved in.this activity, I find it rewarding for them andean enjoymenfcTor me to see them nfovled in such a worthwhile activity. At the last convention, many of the wives were surprised at the fellowship evidenced. The firm handshakes and warm embraces displayed among the former DE sailors touched many of the onlookers. One wife, seeing tears on the cheeks of her husband, exclaimed, "Oh! He's crying!" Another remarked that this 40th year reunion is far more touching than any gathering of the family tree. In response to that remark we can say, "We were a close-kn- it 200 family, who shared the anxieties of war and sea duty; we were a group of young people who displayed the dedication of duty and enhanced the Tjuddy feeling." Present among us were two who were in boot camp together and assigned to the same ship on the same day. Their last contact with each other was when their ship was torpedoed, each landing in a different South Pacific hospital. Through the years they had thought of each other and finally had a rs face-to-fa- meeting. One of the DE sailors who read the published article wrote that he used to visit his friends home and saw above the mantle a large picture of a destroyer escort that his friends uncle served on. Years later this young man enlisted in the service and served on the same ship. The sailor and the uncle both attended the convention. A granddaughter saw the article in her loyal paper.
