The City Council declares its intention to establish a .special improvement district to be known as West Valley City. Utah. Special Improvement District 5. A description of the proposed district is more particularly described in the Notice of Intention' herein attached. The cost and expense of monthly operation of the proposed street lights shall be paid by a special assessment to be levied on all real property within the district benefited by the improvements. The assessment shall be levied according to the benefits to be derived by each property within the district. Such assessments shall be made in accordance with Chapter 16 of Title 10, Utah ('ode Annotated. 1953 as amended. Upon agreement with Utah Power and Light, the system itself and the cost of installation of said system shall be provided and paid for by Utah Power and Light, upon request of West alley City, after the creation of the aforementioned proposed district. Any person who is the owner of property to be assessed in the proposed district described in the Notice of Intention shall have a right to file a written protest against the creation of the district or object to the proposed improvements. Protests shall be filed in the City Recorder s office pursuant to the provisions outlined atin the Notice of Intention tached hereto. The street lights to be installed and operated within Special Improvement District 5 shall be one of the following types, the specific type to be decided subsequent to the public meeting mentioned below Town and Country fixture of fiberglass construction; decorative; aesthetically pleasing. Option No. 2: Wood poles with metal mast arms out over the street not as aesOption No. l: thetically pleasing; better illumination. Option No. 3: Meta poles with mast arm; aesthetically more pleasing than the wood poles; similar illumination to Option 2. NOTE: Regardless of the option selected, it is in- tended that sixty street lights will be installed. ESTIMATED COST OF IMPROVEMENTS The estimated annual cost to operate the street lights in the proposed Special Improvement District 5 as estimated by the City Engineer, will be approximately $7,440 $8,160 per year, dependent upon the option selected as described above, which shall be paid by a special tax to be levied against the lots described above on a per lot basis, those lots being the property which may be affected or specifically benefitted by such street lights. The estimated cost to be assessed against the properties within Special Improvement District 5 will be approximately $31 50 $35.00 per year per lot. The annual costs of operation and the relevied sulting assessment from said costs are based rates upon charged by Utah Power & Light, as controlled by the Public Service Commission. Assessments may. therefore, increase or decrease from their initial level as rates charged by Utah Power & Light, as controlled by the Public Service Commission, vary. ASSESSKM.x I AND LEVY OF TAXES It is the intention of the City Council of West Valley City, Utah, to levy assessments as provided by the laws of Utah on all real property within the district benefitted by said improvements. The purpose of the assessment and levy is to pay those costs of operation of the street lights in Special District 5 improvement which the municipality will not assume and pay. As stated, the method of assessment shall be on a per lot basis for all real property located within Special Improvement District 5. Whether or not said assessment will be billed or annually will be determined at or after the time of the public meeting described below. Other payment provisions and enforcement remedies shall be in accordance with Chapter 16 of Title 10, of Utah Code Annotated, 1953 as amended.
