(UPI) — Thestate attorney general has ruled Chevron Chemical Co. would have to get the Wyoming Legislature's permission to use Wyoming water in a project to move phosphate from Utah to Wyoming Chevron is thinking about building a phosphate fertilizer plant at Rock Springs, Wyo., but the mine that would supply phosphate is in Utah. Chevron has proposed two plans involving Wyoming water for a slurry pipeline to get the phosphate from the Utah mine te Rock Springs. Under Chevron's initial plan, the company would buy 2,200 acre feet of Wyoming watera yearand let it flow down the Green Riverto unspecified usersin Utah. In return, an equal amount of underground water in Utah would be used in the slurrypipeline from the mine to Rock Springs. Underan alternate plan, Chevron would buy the Wyoming water, let it flow down the Green River into Utah, sendit by a pipeline to the mine and then use it in the slurrypipeline to Rock Springs. Under both plans, the water used in the slurry pipeline would be used in the Rock Springsplant. Attorney General Steven Freudenthal and Assistant Attorney General Lawrence J. Wolfe noted in an opinion sought by Gov. Ed Herschler that the Legislature must approve any use of Wyoming water outside the state. Herschler has opposed some proposals to export Wyoming water. Although in both plansvirtually the same amount of water would return to Wyoming as wassent out, the Legislature's approvalstill would be required, the opinion said In the initial plan, the Wyoming water would be sent to unspecified users, so there obviously would be use out of the state, the opinion said In the alternate plan, the Wyoming water eventually would returnto the state, but ‘‘there will undoubtedly be some operational losses and the inevitable transportation losses, ’’ the opinion said. Although it is a close question, we believe that Chevron should be required to seek legislative approval for this proposal.’* The opinion also said Wyoming has authority to sell water to Chevron, and the proposed use of the water complies with the Upper Colorado Basin Compact. Chevron hasindicated it will need to buy 16,000 acre feet of water for the entire project. The state has enough water allocated to it under the compact to sell to Chevron, the opinion said, but there could be a question of whether Wyoming's or Utah's allocations would be charged undertheinitial plan. Wyoming would contend that releasing water to unspecified users in Utah would mean that Utah's allocation should be charged, and ‘we would anticipate that Utah would argue the converse,”’ the opinion said “The determination of which state should be charged for the beneficial use of this water under the initial proposal is not answerableat this time.
