Judge Won't Dismiss Cases SALT LAKE CITY (UPI) — US.District Court Judge Bruce Jenkins has refused to dismiss claims filed by residents of downwind areas who say they were injured by radioactive fallout from the 1950s atomic testing in Nevada. Jenkins ruled Friday on two motions filed by the federal governmentthat the claims of nearly 1,000 residents of Utah, Nevada, and Arizona should be dismissed. The federal government said the statute of limitations has expired on the case. and that the court lacks jursidiction under an exception to the Federal Tort Claims Act.
