NOTICE OF DEFAULT NOTICE is hereby given of the default of that certain Trust Deed, together with the indebtedness secured thereby, which Trust Deed is dated February 16, 1990, and was granted by STERLING HARRIS and JANET H. HARRIS, as Trustors, to VALLEY BANK AND TRUST COMPANY, a Utah Corporation, as Trustee and Beneficiary and recorded on March 2, 1990, at Page 821, at Book 303, as Entry No. 008587, records of the Sanpete County Recorder, State of Utah and which embraces the following de- scribed real property: State of Utah, County of Sanpete: Beginning at the Southeast Corner of Lot 1, Block 69, Plat A, MOUNT PLEASANT CITY SURVEY, and running thence North 7.5 rods; West 13 rods; South 7.5 rods; East 13 rods to point of beginning; containing approximately 0.61 acres, more or less. TOGETHER with all and singu- lar the tenements, hereditaments, rights, rights of way, easements, privileges and appurtenances thereunto belonging, or in anywise appertaining (all as part of the premises hereby conveyed) which shall be deemed to include but not be limited to (1) all mineral rights, rents, issues, profits, damages, royalties, revenue and benefits therefrom; (2) all improvements, fixtures and equipment (whether or not annexed thereto) now or hereafter used in connection therewith; (3) all water and water rights hereafter relating to or used in connection with said property; together with all shares of stock evidencing any such water rights, and all fixtures and equipment for irrigation or drainage. Household appliances are deemed to be fixtures and a part of the realty, and a portion of the security for the indebtedness herein mentioned. All of which aforementioned property, whether real, personal or mixed, shall be hereinafter collectively referred to as Subject property. NOW, THEREFORE, pursuant to the provisions of Section Utah Code Annotated, as amended, the Trustee does hereby give notice that a breach of the obligation for which the trust property was given as security has occurred, and the Trustee does hereby elect to sell or cause to be sold such property to satisfy the obligations secured by the Trust Deed, including appropriate fees, charges, and expenses incurred by the Trustee, advances, if any, under the terms of the Trust Deed, interest thereon, and the unpaid principal and accrued interest of the promissory note secured by the Deed of Trust. The nature of such breach is the failure of the Trustors to pay the Promissory Note secured by the Trust Deed. Hie Trustors have failed and refused to pay monthly installments of $1,259.30 each for the month of May 20, 1991 and for each subsequent month thereafter and the Trustee has elected to accelerate the Promissory Note and declare the entire principal and accrued interest due and payable. Subject to the right of the Trustors to cure the delinquency as provided in Utah Code Annotated (1953, as amended), the amount owing on the Promissory Note is the principal amount of $40,440.18, together with accrued interest in the amount of $2,632.59 and accruing at the rate of $12.35 per day from and after September 10, 1991. In addition, there shall be added thereto the costs, taxes, late fees, insurance, fees and expenses of this foreclosure, including reasonable attorneys fees and advances by the Trustee. That Policy provides that UMPA will purchase energy and capacity offered by QFs at a rate equal to UMPAs full avoided costs. UMPA and its Members further commit to interconnect with any QF that appropriately requests interconnection in accordance with PURPA. UMPA and its Members also assert that the gran tingof this Motion for Waiver shall not subject a QF to any duplicate interconnection charges or charges for wheeling power to UMPA across the transmission lines of a Member. The Federal Energy Regulatory Commission published notice of UMPAs Motion for Waiver in the September 13, 1991 Federal Register. That notice specified that any person desiring to be heard should file a motion to intervene or protest with the Federal Energy Regulatory Commission, 825 North Capitol Street, N.W., Washington, D.C. 20426.
