PLEASAN- T- Sanpete Countys new landfill that has been the topic of major controversy may have another drawback. Only a portion of the 83.02 acres purchased by the county may legally be used for a landfill. The remainder of the property would lie within 1000 feet of a primary highway and utilizing that parcel would put the county in violation of a section of the Utah ' .; ' r Code. 1 the Utah Section Junkyard Control Act, specifically makes it unlawful to build a landfill within 660 feet of federal and state highways. The facility borders Highway 89 near Pigeon Hollow. The act further provides a landfill could be established within 1000 feet of the roadway but it would have to be licensed by the State Road Commission and not be visible from the main traveled roadway. Utah Department of Transportation commission chairman, Sam Taylor, said he was unaware Sanpete had built a landfill on Highway 89 and that no one had come to the commission for a variance or permit. Should Sanpete apply for a permit to operate the landfill, as long as it was no closer than 1000 feet from the highway, proper measures would have to be taken to screen the facility so it would not be visible. In addition, the facility would have to be zoned for industrial use. In the event it was impossible to screen the facility because of the topography of the land, the state road commission would have the authority to acquire by gift, purchase, exchange or eminent domain, such interests in lands as may be necessary to secure the relocation, removal or disposal thereof. If operated in violation of the Junkyard Control Act, Sanpetes landfill could be considered a public nuisance, a misdemeanor, and the road commission could apply to the district court for an injunction to abate the nuisance. As it is, however, the actual landfill operation which is located in the extreme western section of the landfill property, is about 6000 feet off the main highway. As long as Sanpete operates its landfill facility that far off the highway, it can do so legally, according to Sterling Davis, director Utah Department of Transportation District 3. But, he cautioned, if the county gets within 1000 feet of the highway with any of its landfill operation, then it must comply with the Junkyard Control Act. This program and Sacrament meeting will begin at 11:30 a.m. g. 1 ! i Commissioner McGarry said the operating portion of the landfill is about .75 mile off the highway and he would not think of it at all, referring to the state statute. We did what we were supposed to do to take care of the problem with the municipal dumps in the county, he said, noting the EPA could close any one of them at any given time and leave no alternative for solid waste disposal. He did not know how long the county facility would last before the targeted 1000 feet was reached, but estimated the entire parcel should last from between 60 to 100 years. He said he wanted to give residents a choice between a private and county landfill and that mandatory pick up as outlined by recent proposals was only one of many proposals the Continued on page 8 Moroni girl, 12 hurt in accident A Moroni girl received minor injuries when she was struck by a vehicle, Dec. 16 at 8 a.m. Diane Kendall, daughter of Mr. and Mrs. Garth Kendall, was hit by an automobile driven by Ella Mae Faux, Moroni, when she apparently ran in front of the vehicle, at an intersection in the center of town. She was taken by ambulance to Sanpete Valley Hospital where she was treated for shock and ob- - servation and released later that day. Miss Kendall apparently did not see the approaching vehicle, a 1979 sedan, that struck her with the right front fender. Neither the cars driver, Ms Faux, or her passenger, George Faux, were injured. No citations were issued, according to the accident report filed by investigating officer Utah Highway Patrol Trooper Stan Anderson. Snowmobiling prohibited on Eccles Canyon Road PRICE Eccles Canyon Highway from State Highway 96, west to State Highway 31 is closed to ATVs, skiing and snowmobiling, according to George Morris, supervisor of the Manti-LaSNational Forest. The Utah Department of Transportation is maintaining access over this route and heavy equipment could be expected on a daily basis. Normal vehicular traffic is permitted depending on weather conditions. Ira W. Hatch, Price District Ranger, wishes to warn the public that unauthorized winter recreation traffic along this route could be extremely hazardous. Morris also said the public should be aware that the Nuck Woodward Road is closed to all traffic from State Highway 31, north to the forest boundary above Barn Canyon. They all understood what the requirements were and had no problem with it, Davis said. Davis said he also visited with county officials to approve highway access into the landfill facility. Access was granted because no traffic hazard was posed.
